7.20.10 Deposit Prohibited In Smith River

It is unlawful to deposit in or cause, suffer or procure to be deposited in or to permit to pass into the Smith River, any debris, substance or tailings from hydraulic, placer, milling or other mining activities.

7.20.20 Settling Ponds; Check Dams

It is unlawful to conduct any mining operations in Del Norte County, California, without constructing a settling pond or ponds, check dam or dams, or without undertaking other adequate means to prevent the collection of debris, substance or tailings on the bed of Smith River.

7.20.30 Nuisance

Any structure or contrivance or any mining operations which causes or contributes to the condition, the causing of which is prohibited in this chapter, is a public nuisance, and any person, firm, or corporation maintaining or permitting the same is guilty of maintaining a public nuisance and it shall be the duty of the district attorney of Del Norte County to bring action to abate such public nuisance.

7.20.40 Violations

Any person, firm or corporation violating any of the provisions of this chapter is guilty of a misdemeanor.
