1.41.010 Definitions

  1. "Local Agency" means the Del Norte County board of supervisors, and all other commissions, boards, officers and agents of the county.

1.41.020 State Law Applicable

Pursuant to the provisions of Section 1085 of the Code of Civil Procedure, the provisions of said section are hereby applicable to the Local Agency.

1.41.030 Writ Of Mandate

Judicial review of any petition for writ of mandate pursuant to Section 1085 of the Code of Civil Procedure, not otherwise preempted by a statute of limitations established by the California State Legislature, shall be filed not later than the 60th day following the date on which the decisions becomes final. A decision is final on the date it is made.

1.41.040 General Statute Of Limitations

Except otherwise preempted by State law, the Board of Supervisors hereby separately declares its intent and does hereby establish a statute of limitations in which a legal action, suit or proceeding may be initiated in which to attack, set aside, void or otherwise annul any action of the Local Agency. Any such action shall be

initiated and filed in the appropriate court within sixty (60) days of the effective date of the ordinance or from the date a decision is made by the Local Agency, or sixty (60) days from the effective date of this ordinance, whichever is later, otherwise any such suit shall be barred.
