Del Norte County Municipal Code § 3.32 Criminal Justice Collection Fees

Pursuant to Penal Code Section 1205(c), there is established a fee to be assessed to defendants in criminal matters who are permitted to pay a fine in installments. The amount of the fee to be collected by the officer collecting the fine shall be in an amount, which reflects the actual cost of collection, which is determined to be ten percent of the total amount collected from a defendant for a single judgment, but in no case to be less than ten dollars nor to exceed thirty dollars. No fee shall be collected where the fine is paid within thirty days following the imposition of sentence.

Pursuant to Penal Code Section 1203.1 there is established a fee to be assessed to defendants when a court orders that the defendant pay restitution to the victim. The amount of the fee to be collected by the officer collecting the restitution shall be two percent of the amount collected which is determined to be less than the actual cost of collection. No fee shall be collected where the restitution is paid to the officer collecting the restitution within thirty days of the date such restitution is ordered by the court.

Fees collected pursuant to Sections 3.32.10 and 3.32.20 shall be deposited in the county general fund for the use of the county.
