7.12.10 Definitions¶
"Person" as used herein includes a partnership, a corporation, as well as a natural person.
"Engaging in the business of cleaning cesspools, septic tanks, privies and vaults and the removal of contents for cleaning thereof" as used herein, includes but is not limited to any person who goes about from place to place with apparatus or equipment designed for cleaning cesspools, septic tanks, privies and vaults, or who shall have an established place of business for this purpose and who shall make a charge for these services.

7.12.20 Permit; Required¶
No person shall engage in the business of cleaning cesspools, septic tanks, privies and vaults and the removal of the contents thereof within the county without first having obtained from the department of public health of the county a permit so to do as hereinafter provided.

7.12.30 Permit; Application¶
All persons who desire to engage in the business of cleaning cesspools, septic tanks, privies and vaults and the removal of the contents thereof within the county will make and file with the department of public health a written application for a permit so to do.

7.12.40 Permit; Applicant Investigation¶
It shall be the duty of the department of public health, upon receiving an application for a permit as herein provided, to investigate the character of the applicant, the kind and type of apparatus and equipment he intends to use in cleaning cesspools, septic tanks, privies and vaults, the place or places to which the contents of any cesspool, septic tank, privy or vault may be removed and if the department of public health is satisfied from the investigation, to issue a permit to the applicant upon the payment of a fee of fifty dollars for each permit issued and the giving of a personal or surety bond of one thousand dollars conditioned for the faithful performances of all duties enjoined by this chapter or the department of public health.

7.12.50 Permittee Rules And Regulations¶
Every person who obtains a permit provided for in this chapter shall be subject to the rules and orders of the department of public health in the following matters:
The manner of cleaning any cesspool, septic tank, privy or vault.
The removal of the contents thereof and the place to which the contents are moved.
Refusal to obey and carry out the orders and rules of the department of public health in the manner herein specified, shall be grounds for the revocation of the permit referred to in this chapter.

7.12.60 Permit; Termination, Renewal¶
Any permit issued pursuant to this chapter shall be valid for a period of one year from the date of issuance unless thereafter revoked by order of the department of public health as herein specified and any permit issued pursuant to this chapter may be renewed from year to year upon the filing of a written application, the payment of the fee and the giving of the faithful performance bond as provided for in Section 7.12.40.

7.12.70 Violation; Use Of Performance Bond Funds¶
In the event that the holder of a permit issued pursuant to the provisions of this chapter violates any of the provisions hereof, or any rules or orders of the department of public health this violation shall permit the county at its option to resort to the faithful performance bond for the payment of a penalty of one thousand dollars.

7.12.80 Engaging In Business Without Permit Prohibited¶
It is unlawful for any person to engage in the business of cleaning cesspools, septic tanks, privies and vaults and removing the contents thereof without first having obtained a permit so to do from the department of public health.
