2.36.10 Consumer Affairs Division; Established

A county-wide consumer affairs division of the Del Norte County department of weights and measures is established.

2.36.20 Consumer Affairs Division; Administration

The Del Norte County sealer of weights and measures is authorized to administer the division and direct the program as follows:

  1. To receive complaints of unfair business practices and dealings against the consumer.

  2. To report all law violations in connection therewith to the proper city, county, state or federal agency.

  3. To assist, develop and conduct programs of consumer education before organizations on request.

  4. To disseminate information through the news media, displays and pamphlets, alerting consumers to misleading and deceptive practices.

  5. To cooperate with city, county, state and federal agencies to protect and promote the interests of Del Norte County consumers.

  6. To encourage local business and industry to maintain high standards of honesty, fair business practices and public responsibility in products, promotion and sale of consumer goods and services.

2.36.30 Consumer Affairs Division; Defrayment Of Costs

At least one-half of the total amount of fines collected by the county from violators of consumer fraud statutes shall be utilized to defray the cost of the consumer affairs division established in Section 2.36.10.

2.36.40 Noncommercial Devices; Fees

The fees to recover the cost of inspecting or testing those weighing and measuring devices tested or inspected pursuant to Business and Professions Code Section 12210, subdivision (b), shall be fifty dollars per device. For any inspection which involves more than one hour, an additional fee of fifty dollars per hour shall be charged.

2.36.45 Commercial Devices; Fees

  1. Pursuant to California Business and Professions Code, Section 12240, the fees to recover the cost of inspecting or testing those weighing and measuring devices required of the County sealer to be tested or inspected pursuant to Business and Professions Code Section 12210, subdivision (a) and Section 12211

shall be as set forth in Business and Profes sions Code Section 12240, and as such section is hereafter from time to time amended.

  1. In addition to any inspection required by law, the county sealer may inspect or test any weighing or measuring device or instrument used commercially, at the request of the owner or user. If such inspection or testing could legally be per formed by a registered repairman, the county sealer shall collect from the requesting owner or user a fee, which shall be based upon the Uniform Schedule of Fees described in Section 12210.5 of the California Business and Professions Code, as such schedule is amended from time to time.
