1.50.10 Purpose¶
It is the purpose of this chapter to provide a uniform procedure for the presentation of all claims for money or damages against the county of Del Norte. This purpose is implemented by requiring all such claims to be presented and acted upon in accordance with the procedures set forth in the Tort Claims Act (Division 3.6 of Title 1 of the California Government Code).

1.50.20 Scope And Application¶
Pursuant to section 935 of the California Government Code, any claim against the county of Del Norte, or against any local public entity governed through the Del Norte County board of supervisors, for money or damages, which is excepted by Section 905 of the California Government Code from the provisions of Division 3.6 of Title I of the California Government Code (Section 810 et seq.), and which is not governed by any other statutes or regulations expressly relating thereto, shall be governed by this chapter.

1.50.30 Claims Procedure¶
Any claim described in Section 1.50.20 must be presented in accordance with the procedures and time limitations set forth in Division 3.6 of Title 1 of the California Government Code (Section 810 et seq.).

1.50.40 Claims Requirements¶
No suit for money or damages may be brought against the county of Del Norte, or any local public entity governed through the Del Norte County board of supervisors, on a cause of action for which this chapter requires a claim to be presented until a claim therefor has been presented and acted upon in conformity with this chapter and Division 3.6 of Title 1 of the California Government Code (Section 810 et seq.).

1.50.50 Operation¶
This chapter shall apply to any claim or potential claim which arises after the effective date of this chapter. This chapter shall also apply to any claim or potential claim existing on the effective date of this chapter unless such application would violate the constitution or laws of the United States or of the state of California.
