15.12.10 Short Title

The ordinance codified in Chapters 15.08 through 15.44 shall be known as the "sanitary code of Del Norte County Service Area No. 1."

15.12.20 Purpose

The purpose of Chapters 15.08 through 15.44 is to provide for the maximum possible beneficial public use of the district's facilities through adequate regulation of sewer construction, sewer use and industrial wastewater discharges, to provide for equitable distribution of the district's costs, and to provide procedures for complying with requirements placed upon the district by other regulatory agencies.

15.12.30 Scope; Interpretation

  1. Chapters 15.08 through 15.44 shall be interpreted in accordance with the definitions set forth in Chapter 15.08.

  2. The provisions of Chapters 15.08 through 15.44 shall apply to the direct or indirect discharge of all liquid-carried wastes to facilities of the district. Chapters 15.08 through 15.44, among other things, provide for the regulation of sewer construction in areas within the district, the quantity and quality of discharged wastes, the degree of waste pretreatment required, the setting of waste-discharge fees to provide for equitable distribution of costs, the approval of plans for sewer construction, the issuance of permits for industrial wastewater discharge and of other miscellaneous permits, and the establishment of penalties for violation of Chapters 15.08 through 15.44.

15.12.40 Regulations Board Adoption Authority

The board shall adopt, by resolution, such regulations from time to time as it shall deem fit, setting forth construction requirements for sewers, materials for sewers, charges for connection, sewer use charges, materials prohibited to be discharged, regulation of the sewage system, discharge and construction permits, and the like.

15.12.50 Rules And Regulations Applicable

The rules and regulations set forth in Chapters 15.08 through 15.44 respecting sewer construction and disposal of sewage and drainage of buildings and connection to the sewage works of the district are hereby adopted, and all work in respect thereto shall be performed as herein required and not otherwise.

15.12.60 Sewage Disposal Policy Generally

  1. The district operates systems of trunk and collector sewers serving homes, industries and commercial establishments. Also, the city has built and operates wastewater treatment and disposal facilities.

  2. Generally, liquid wastes originating within the district's boundaries will be removed by the district's sewerage systems provided the wastes will not:

    1. Damage structures.

    2. Create nuisances such as odors.

    3. Menace public health.

    4. Impose unreasonable collection, treatment or disposal costs on the city.

    5. Interfere with wastewater treatment processes.

    6. Exceed quality requirements set by regulatory government agencies; or

    7. Detrimentally affect the local environment.

  3. The highest and best use of the district and city's sewerage systems is the conveyance, treatment and disposal of domestic wastewater. The use of the city's treatment and disposal systems for industrial wastewater discharges is subject to further regulation by the city.

  4. To comply with stated policies of the state and federal governments and to permit the district and city to meet increasingly higher standards of treatment-plant effluent quality provisions are made in Chapters 15.08 through 15.44 for the regulation of industrial wastewater discharges. These chapters provide guidelines for establishing quantity and quality limitations, by separate resolution, on industrial wastewater discharges which may adversely affect the district and/or the city's effluent quality. Guidelines for cost recovery from industrial wastewater dischargers are also established for adoption by separate resolution. Further, these chapters provide guidelines for establishing connection and user fees by separate resolution.

  5. Optimum use of the facilities of the district may necessitate that the district require that certain industrial wastewaters be discharged during periods of low flow in the sewerage systems of the district.

15.12.70 District Inspector; Manager Authority

The manager may personally perform or employ some fit and qualified person or persons to perform the duties of inspecting the installation, connection, maintenance and use of all side sewers and public sewers, and facilities in connection therewith in said district, to be known as the "district inspector."

15.12.80 Suspension Or Modification Of Regulations; Board Authority

The board may, on its own motion, find that by reason of special circumstances any provision of these regulations and Chapters 15.08 through 15.44 should be suspended or modified as applied to a particular premises, and may, by resolution, order such suspension or modification for such premises during the period of such special circumstances, or any part thereof.

15.12.90 Suspension Or Modification Of Regulations; On Application

When any person, by reason of special circumstances, is of the opinion that any provision of Chapters 15.08 through 15.44 is unjust or inequitable as applied to his premises, he may make written application to the board, stating the special circumstances, citing the provision complained of, and requesting suspension or modification of that provision as applied to his premises. The board shall rule upon the application within thirty days of acceptance.

15.12.100 Permits And Fees

No public sewer, lateral sewer, building sewer or other sewerage facility shall be installed, altered or repaired within the district until a permit for the work has been obtained from the district and all fees paid in accordance with the requirements of Chapter 15.36.

15.12.110 Regulations Posting; Effective Date

Upon adoption, the ordinance codified in Chapters 15.08 through 15.44 shall be posted in three public places within the district, and shall become effective upon the expiration of thirty days from November 28, 1977, the date of its adoption.

15.12.120 Conformity With Regulations Required

Following the effective date of the ordinance codified in Chapters 15.08 through 15.44, it shall be unlawful for any person whose building is required to be connected to a public sewer under Section 15.16.20 to connect to, construct, install or provide, maintain and use any other means of sewage disposal from said building except by connection to a public sewer in the manner as provided in Chapters 15.08 through 15.44
