2.98.10 Title¶
This chapter shall be known as the "Incompatible, incon sistent or conflicting employment ordinance."

2.98.20 Chapter Purpose¶
The board of supervisors declares that this chapter is adopted for the purpose of preventing any county employee from engaging in any employment, activity, or enterprise for compensation which is inconsistent, incompatible, in conflict with, or inimical to his duties as a county employee, or where any part of his efforts will be subject to approval by any other officer, employee, board or commission of the county, unless otherwise authorized in this chapter.

2.98.30 Certain Outside Activities Prohibited¶
The following outside activities are determined by the board of supervisors to be inconsistent with, incompatible to, or in conflict with all employees' duties and are therefore prohibited:
Any activity which involves the use for private gain or advantage of the county's time, facilities, equipment and sup plies, on the badge, uniform, prestige or influence of the employee's office or position.
Any activity which involves receipt or acceptance by the employee of any money or other consideration from any one other than the county for the performance of an act which the employee would be required or expected to render in the regular course or hours of his county employ ment or as a part of his duties as a county employee.
Any activity which involves the performance of an act in other than his capacity as a county employee which act may later be subject directly or indirectly to the control, inspec tion, review, audit or enforcement of any other county em ployee.
Any activity which involves such time demands as would render performance of his duties as a county employee less efficient.

2.98.40 Request To Conduct Outside Activity¶
Any employee conducting or desiring to conduct any out side activity in addition to his regular duties as a county em ployee for profit or other compensation shall report the activity in writing to his immediate supervisor. The supervisor shall refer the matter to the personnel officer who shall determine whether the activity is prohibited by the terms of this chapter. Notice of the determination shall be delivered to the employee by the per sonnel officer in writing.

2.98.50 Appeal¶
An employee dissatisfied with the determination of the personnel officer may appeal the decision to the board of super visors, which shall schedule the matter for a hearing within twenty days of the receipt of the employee's request. The board's decision shall be final.

2.98.60 Employment By Private Business¶
It is not the intent of this chapter to prevent the employment by private business of county employees, such as a peace officer, among other employees, who are off duty to do work related to and compatible with their regular employment, or past employment, provided the employee has the approval of his supervi sor and is certified as qualified by the appropriate county operations committee.

2.98.70 Offices Declared Compatible¶
It shall be deemed the holding of a compatible office for any county officer of the County of Del Norte, including a County Supervisor, concurrently to serve as a member of the governing body of a public entity, whose primary purpose is providing utility service within or without the boundaries of the County of Del Norte.
