3.56.010 Policy for Advertising on Tuolumne

County Transit Vehicles

A. Acceptance of all advertising on Tuolumne County Transit (TCT) vehicles is subject to Tuolumne County Director of Public Works approval and agreement by the Advertiser to indemnify and protect the County of Tuolumne from loss and expense on claims and suits based upon contents of advertisements. This includes, but is not limited to, libel, plagiarism, copyright infringement and unauthorized use of person’s name or photograph.

B. Permitted advertisements shall mean and refer to only commercial advertisements, which propose a commercial transaction. Permitted advertisements shall not include any of the following: • Political advertising, including, but not limited to, advertisement implying a position for or against any political candidate, public issue or subject. • Advertisements that contain or promote the sale or use of alcohol and tobacco products. • False, misleading or deceptive advertisements. • Advertisements that promote illegal activity or which advocate violence or crime. • Advertisements that contain language that is obscene, vulgar or profane. • Advertisements that contain obscene matter or sexually explicit material. • Advertisements that infringe upon any copyright, patent or service mark. • Advertisements implying a position for or against any religion. • Advertisements that contain images, copy or concepts that actively denigrate a specific age, religion, ethnic or gender group. • Advertisements that contain images, copy or concepts that actively denigrate public transportation. • Other noncommercial advertisements or noncommercial speech. Exceptions: Governmental entities, meaning public entities specifically created by government action, may acquire advertising space for messages that advance specific government purposes, except the space may not be used for advertising for or against a political candidate or issue of public debate.

C. Tuolumne County Department of Public Works Right of Rejection: In all contracts, the Tuolumne County Department of Public Works reserves the right to reject any advertising content submitted for display on its properties and to order the removal of any advertising posted on its properties. If advertising on display is subsequently determined to be inappropriate, it shall be removed within 72 hours of receipt of written notification from the Director of Public Works. Decisions regarding the approval, rejection or removal of advertising shall be made by the Tuolumne County Director of Public Works, or his designee, in conformance with the criteria in this policy statement.

3.56.020 Fee Schedule.

The following fees shall be charged by the County for advertising on Tuolumne County Transit Buses. A. For a twelve month term per bus, tail
mount: $150.00 per month. Total per year = $1,800.00. B. For a twelve month term per bus,
side mount or Gerbervision on side window: $100.00 per month. Total per bus = $1,200.00 total. C. For a twelve month term per bus,
Gerbervision on rear window: $200.00 per month.
Total per year = $2,400.00 D. In addition to the advertising fees
identified in Sections A through C above, each advertiser shall pay 100% of the cost of printing and installation of their sign(s). E. Advertiser shall pay fifty percent
(50%) of the total cost of their advertising fee prior to printing and installation of sign(s). F. Advertiser shall pay the remaining
fifty percent (50%) of the total cost of their advertising fee halfway through the advertising term. G. All fees paid are not refundable
except where fees are paid that cover a time period that exceeds the term advertising space is provided.

Mounted advertising signs shall be installed into a mounting frame located on the rear (“tail”) or side of the bus(es). Gerbervision signs shall be installed to cover the rear or side window(s) of the bus(es).
