18.04.010 Definitions. The following

definitions shall apply to these rules and regulations for the use of airports owned and operated by the county: A. "Airport" means Columbia Airport and Pine Mountain Lake Airport located in the county. B. “Airport manager” means, the Director of Public Works or his/her designee. C. "Based aircraft" means any aircraft assigned a reserved parking space, tiedown, or hangar space, whether or not such assignment is made under a written lease with the county. D. "FAA" means the Federal Aviation Agency of the United States of America, as defined in the Federal Aviation Act of 1958, or any subsequent and successory body to that agency created for the control and operation of aviation and its related functions. E. "Owner" means the registered or legal owner of an air-craft according to the records of the FAA. F. "Rules and regulations" means the provisions contained in this chapter and such other regulations as are adopted by the board of supervisors.
G. AApproved usable storage@ means storage incidental to the use of permitted aircraft which would also allow sufficient access, as determined by the County Fire Marshal, to fire fighting personnel in an emergency. No personal storage beyond which is incidental to the use of the permitted aircraft is allowed. (Ord. 3124 § 1, 2010; Ord. 2615 ' 2 (part), 2005; Ord. 924 ' 2 (part), 1977; prior code ' 14-1.0).

18.04.020 Airport manager. The airport shall

be under the supervision of an airport manager appointed by the board of supervisors. The airport manager shall at all times have authority to take action necessary to safeguard the public and attendants at the airport and to make and enforce rules and regulations in addition to those provided in this chapter. He shall also have authority to adopt such rules and regulations as are necessary in an emergency. (Ord. 924 ' 2 (part), 1977; prior code ' 14-1.1).

18.04.030 Regulations for use of the airport.

All persons using the airport shall be subject to, and governed by these rules and regulations, all county ordinances and resolutions, state and federal laws and FAA rules and regulations. (Ord. 924 ' 2 (part), 1977; prior code ' 14-1.2).

18.04.040 Open for public use at all hours. The

airports shall be open for the public use at all hours of the day and night subject to the rules and regulations set forth in this chapter, and subject to such restrictions due to inclement weather, the condition of the landing area, the presentation of special events and like causes, as may be determined by the airport manager. 18.04.050 User of airport assumes risk and

responsibility. The privilege of using the airport and facilities shall be conditioned on the assumption of full responsibility and risk by the user thereof, and he/she shall release, hold harmless and indemnify the county, their offices and employees from such use as well as against

18.04.060 Use of hangars. Hangars are

intended for the storage of aircraft only. All storage within a hangar shall be approved usable storage. Only minor repairs on one's own aircraft will be permitted. (Ord. 2615 ' 3, 2005; Ord. 924 ' 2 (part), 1977; prior code ' 14-1.5).

18.04.070 Business or commercial activities.

No person shall engage in a business or commercial activity of any nature on the airport except in conformance with the requirements of the board of supervisors and the airport manager and under the terms and conditions they may prescribe. (Ord. 924 ' 2 (part), 1977; prior code ' 14-1.6).

18.04.080 Improvements. Any improvements to

a hangar must be approved by the airport manager.(Ord. 2615 ' 4, 2005; Ord. 9.14 ' 2 (part), 1977; prior code ' 14-1.7).

18.04.090 Regulations for the use of the

airport. No person shall use any portion of the airport, including but not limited to any hangars or parking spaces thereon, in any manner whatsoever for any commercial, profit, gainful or revenue producing purpose, including but not limited to flight instruction or mechanical work, or any charitable purpose without the written approval of the county. Such written approval, by lease or otherwise, shall be granted only pursuant to standards and regulations established by resolution of the board. 18.04.100 Restriction on number of persons

using the airport. The county may restrict the number of persons using the airport to such number as the county may deem necessary to protect the public health, safety and welfare. (Ord. 1082 ' 1 (part), 1980; Ord. 924 ' 2 (part), 1977; prior code ' 14-1.8 (part)).

18.04.110 Encroachment. No person shall

encroach on the airport without first having obtained a permit from the airport manager pursuant to regulations established by resolution of the board. No new private taxi-way access to Columbia Airport shall be granted. (Ord. 1343 ' 1, 1984; Ord. 1082 ' 1 (part), 1980; Ord. 924 ' 2 (part), 1977; prior code ' 14-1.8 (part)).

18.04.120 Violations of this chapter. Any

person found in violation of this chapter is guilty of a misdemeanor. Notwithstanding a criminal conviction for a violation of this chapter, any person found in violation of this chapter may be temporarily or permanently barred from operating equipment on the airport or use of the airport, or have any permit issued under this chapter revoked as reasonably determined by the Airport Manager.
