I. Health.

General Clinic Fees

a. In order for the County to receive the maximum allowable reimbursement for clinical services whether those services are state and federally funded or private pay, the County of Tuolumne shall follow the rate system set by EDS/Medi-Cal fee structure and state and federally funded programs.

Special testing, immunization and supply services shall be charged at actual cost to the County.

A waiver policy (full and partial) developed by the Human Services Agency Director shall be available for services provided related to communicable diseases, sexually transmitted diseases and immunizations.

3.40.020 Annual adjustment.

A. Unless prohibited by statute, the fees established in Section 3.40.010 shall be increased or decreased on the subsequent July 1st by the same percentage increase or decrease granted to county employees represented by recognized employee organizations during the prior fiscal year.

B. Notwithstanding subsection A of this section, future adjustments of airport fees as set forth in Section 3.40.010(T) shall be on an annual basis according to the rate of the San Francisco region, all urban consumers, Consumer Price Index (CPI), measured from December to December and applied each successive July.

C. Subsection A of this section shall not apply to the property tax administration fees set forth in Section 3.40.010(E) and the work furlough/electronic monitoring fee set forth in Section 3.40.010(L). 3.40.030 Payment of fees and refunds.

A. Except where by their nature they may not be collected in advance, all fees established in Section 3.40.010 shall be collected in advance.

B. All fees collected are not refundable except for fees collected where the service is not performed. Notwithstanding the above, refunds of fees established in Section 3.40.010(V) shall be made pursuant to a refund policy adopted by the Recreation Director who may impose reasonable conditions on refunds. Notwithstanding the above, when an application for an entitlement is withdrawn by the applicant, refunds of fees established in Section 3.40.010(H), (K), (P) and (W) shall be made on a prorated formula based upon the amount of work expended by county agencies as of the date of withdrawal of the application. The Community Development Director shall establish a formula for prorating refunds of fees established in Sections 3.40.010(H), (K) and (W). The Public Works Director shall establish a formula for prorating refunds of fees established in Section 3.40.010(P).

C. Unless prohibited by statute, any county department may refuse to provide service to a person where past due fees from that person to any county department remain unpaid.

D. As set forth in Section 3.40.010(T), a ten dollar late charge shall be added to each account, per month, for each month that the account is delinquent. Notwithstanding the above, late charges on long-term car parking shall be set at ten percent of the monthly fee for each month that the account is delinquent. Accounts delinquent three months or more will be referred to the county's central collections branch for action.

E. As set forth in Section 3.40.010(H), a five percent late charge, with a ten dollar per month minimum charge, shall be added to each account, per month, for each month that the account is delinquent. Accounts delinquent for three months or more will be referred to the county's central collections branch for collection.

F. With regard to fees established in section 3.40.010(P)(28), the board of supervisors may adopt a policy by resolution deferring all or a portion of said fees until the completion of the permanent road division zone of benefit formation. The board shall review any deferment request. 3.40.040 Calculation of development fees. The fees

for land development entitlements shall be calcualted as follows:
A. The fees set forth in Sections 3.40.010(K), (P)(4), and P(8) through P(22) shall be waived 100% for the following:

  1. Public utilities, agencies and districts
  2. Schools of an academic nature
  3. Shelters for the homeless
  4. Crisis centers
  5. Church/worship facilities, excluding camps
  6. Museums that are open to the public without charge
    B. The fees set forth in Sections 3.40.010(K)(1)(a) General Plan Amendment, 3.40.010(K)(2)(a) Planned Unit Development Permit, 3.40.010(K)(3)(a) Zone Change, 3.40.010(K)(4)(a) Development Agreement, 3.40.010(K)(5)(a) Conditional Use Permit , 3.40.010(K)(6)(a) Site Development Permit, 3.40.010(K)(8) Site Review Permit, 3.40.010(K)(9)(a) Variance, 3.40.010(K)(10) Agricultural Preserve, or 3.40.010(K)(11) Williamson Act Contract shall be waived as follows for applications submitted under any of these subdivisions concurrently with an application for which the fees set forth in Section 3.40.010(P)(4)(a) Tentative Parcel Maps (CEQA Exempt) have been paid provided the Applicant presents a copy of the payment receipt at the time the waiver is requested:

50% for any application exempt from CEQA submitted under Sections 3.40.010(K)(1) through (K)(6), (K)(8), (K)(9), (K)(10), or (K)(11) concurrently with an application for which the fees set forth in Section 3.40.010(P)(4)(a) have been paid provided the application subject to the fees in Section 3.40.010(K) has been determined to be exempt from the California Environmental Quality Act (CEQA) or the potential impacts of the application or applications have been adequately addressed in a previously prepared

environmental review in accordance with CEQA.
2. When two or more applications exempt from CEQA are submitted concurrently under Sections 3.40.010(K)(1)(a), (2)(a), (3)(a), (4)(a), (5)(a) (7)(a), (9)(a), (10) (11), 100% of the largest fee shall be paid and 60% of each of the other fees shall be waived under Sections 3.40.010(K)(1) through (K)(31).
C. The fees set forth in Sections 3.40.010(K), (P)(4), and P(8) through P(22) shall be waived on a one for one percentage basis for applications for affordable housing as defined in Title 17 of this Code. For example, if 25% of the housing units proposed in the application qualify as affordable housing, then 25% of the fees shall be waived.
D. The fees set forth in Section 3.40.010(W) shall be waived for the construction of inclusionary units as defined in Section 17.04.449 of this code.
E. The fees set forth in Section 3.40.010(P)(4)(a) and (P)(4)(d) shall be waived for applications to rescind a condition of an approved tentative parcel map that requires the payment of the in- lieu fee for affordable housing as provided in Section 17.65.040 of this Code.
F. Notwithstanding Section 3.40.040(E), the fees set forth in Sections 3.40.010(K)(1) through (K)(13) and (K)(29), 3.40.010(P)(4)(a), (P)(4)(c) and (P)(4)(d), and 3.40.010(P)(35) shall be either charged or waived as follows for applications submitted under any of these subdivisions to rescind, amend, or revise an approved entitlement (project)that has not expired as provided in this Code or as provided by state law:

  1. 75% of fee waived for applications to rescind the approval of an entitlement.
  2. 75% of fee waived for applications to amend or rescind a condition of approval of an entitlement not subject to CEQA.
  3. 50% of fee waived for applications to revise the project approved under an entitlement where the revision is not subject to CEQA.
  4. $1000 deposit plus Time and Materials shall be charged for applications to revise the project approved under an entitlement where the revision is subject to CEQA. G. The fee set forth in Section 3.40.010(P)(35) shall be waived 50% for applications submitted concurrently with an application under Section 3.40.010(K)(8), Section 3.40.010(P)(4)(a) or Section 3.40.010(P)(4)(d).
    H. Fees described above that require a deposit and Time and Materials are charged at "actual cost". If two or more entitlements are submitted that require a deposit and Time and Materials, only one deposit shall be collected for the multiple entitlements on the application. In addition to fees charged for processing, additional fees may be required to include any necessary consultant costs for environmental review, specialized studies, financial consulting or any other expert consulting services potentially needed by the County for processing these applications. Monthly draws against the deposit will be made based on staff time and materials needed to process the applications. Staff costs and expenses for work completed by County staff will be billed at fully burdened weighted labor rates as approved by the Auditors Office at the time of services rendered. Invoices will be calculated on a quarterly basis and forwarded to the Applicant for payment. If the deposit reaches a balance of 20% of the initial deposit or less, the Applicant will be asked to make a subsequent deposit in an amount dependent upon the amount of work left to complete on processing. Applicants will be expected to pay the subsequent deposit within 30 days of invoice date. In the event that the account is not paid within 30 days of the invoice date, processing will be suspended until such time that payment is made. Any remainder will be used to reconcile a final bill. If there is a balance remaining after reconciling the final bill, a refund check will be mailed to the project Applicant/Financially Responsible Party. Public hearings will not be scheduled until payment in full is received. I. The fees set forth in Sections 3.40.010(K)(31) through (33), Time and Materials will be charged at "actual cost". Staff costs and expenses for work completed by County staff will be billed at fully burdened weighted labor rates as provided by the Auditors Office at the time of services rendered. Invoices will be calculated at the end of the project/task and forwarded to the Applicant for payment. J. For Time and Materials charges, an Applicant and/or Financially Responsible Party may request in writing a review of the County charges within 10 calendar days of either 1) receipt of the full accounting of the fees charged on a completed application or closed permit; or 2) upon receiving and complying with more than one request by the County for additional deposit monies on a single application or permit. The disputed charges must be paid in order for the appeal process to proceed. The charges will be refunded at the end of the appeal process if found to be in Applicant and/or Financially Responsible Party's favor. The Community Development Director or designee (hereinafter "Hearing Officer") shall review the request within 10 business days of receiving the request. The Hearing Officer shall determine that the charges were or were not justified and may adjust the charges appropriately. The Hearing Officer shall notify the Applicant and/or Financially Responsible Party by mail and/or email the decision within three working days of making the final decision. The decision of the Hearing Officer is final. K. The fees set forth for permits and inspections conducted under 3.40.010(H) and 3.40.010(W) shall be

adjusted proportionally when multiple inspections are performed during a single site visit. 3.40.045 Tuolumne In-Lieu Parking Fee. The

Tuolumne Parking Fund and the Tuolumne In-Lieu Parking Fee are hereby established to provide an alternative to the parking requirements in Chapter 17.60 of this code for the area within the boundary of the Tuolumne Parking & Alley Study dated October 15, 2010, as it may be amended by the Board of Supervisors, subject to the following:

A. The fee shall be $3,900 per parking space;

B. On July 1 of each year, the fee shall be automatically increased or decreased by the percentage increase or decrease in the San Francisco Consumer Price Index, All Items, all Urban Consumers, published by the U.S. Department of Labor, for the preceding 12- month period;

C. The fee shall be paid to the Community Resources Agency prior to the issuance of a certificate of occupancy or, if the project does not require a building permit, prior to commencing any activity pursuant to an entitlement granted pursuant to Title 17 of this code, or the property owner shall have the option to execute an agreement with the County to pay the fee in annual installments in conjunction with real property taxes. The installments shall be no less than $500 per year per parking space and the first payment may be delayed one year from the date of execution of the agreement. The agreement shall be executed prior to issuance of a certificate of occupancy or, if the project does not require a building permit, prior to commencing any activity pursuant to an entitlement granted pursuant to Title 17 of this code;

D. The fee amount shall be determined by the fee schedule in effect on the date a building permit is issued, or, if the project does not require a building permit, the date specified in an entitlement granted pursuant to Title 17 of this code;

E. When application is made for a new building permit following the expiration of a previously issued building permit for which the fee was paid, an additional fee payment shall be required only if the fee schedule has been increased during the interim;

F. When a fee is paid for a development project and the project is subsequently abandoned, the County Auditor shall refund the fee paid upon Community Resources Agency written confirmation that the project has been abandoned;

G. The fee shall be deposited into the Tuolumne Parking Fund and shall only be expended as authorized by the Board of Supervisors for the purpose of providing parking within the boundary of the Tuolumne Parking & Alleyway Study dated October 15, 2010, as it may be amended by the Board of Supervisors, and in accordance with the Tuolumne In-Lieu Parking Program established in Chapter 17.60 of this code. 3.40.050 General Plan Update Fee. The General Plan

Update Fee is hereby established to be used to complete updates of the County’s General Plan. California State law requires that every jurisdiction adopt a comprehensive General Plan to guide the community’s development (California Government Code Section 65301). Government Code section 65104 recognizes that the legislative body of the jurisdiction may establish fees to support work including, but not limited to, the adoption of a General Plan. The fee shall be $5.00 and charged to all permits and entitlements issued by the Community Development Department at time of issuance or approval and shall be deposited into a fund for the purposes of updating the County’s General Plan. General Plan Implementation Fee is hereby established to be used to complete updates of the County’s General Plan. Updates are needed from time to time to respond to State or local regulations. Government Code section 65104 recognizes that the legislative body of the jurisdiction may establish fees to support the implementation of the General Plan. The fee shall be $5.00 and charged to all permits and entitlements issued by the Community Development Department at time of issuance or approval and shall be deposited into a fund for the purposes of implementing the County’s General Plan.
