12.04.010 Permission to construct required. No¶
person, firm or corporation shall construct approaches, driveways, streets and/or other vehicular entrances to county roads or highways without first obtaining permission therefor from the office of the County Road Commissioner, and said construction shall be in accordance with the regulations and requirements set forth in this chapter. 12.04.020 Connecting roadways subject to¶
removal. Any such approaches, driveways, streets and/or other vehicular entrances, hereinafter referred to as connecting roadways, shall be considered as encroachments and are subject to removal by the County Road Division of the Public Works Department in the event that it creates a hazard or interference with the county road system or in the event that in the future it is necessary to effect such removal in the best interests of the county road system for the widening of roadways or other like activity. All such connecting roadway shall be constructed, maintained, repaired and operated at the expense of the person installing the same, or his/her or their successor in interest. 12.04.030 Interference with vehicular traffic¶
prohibited. All connecting roadways shall be constructed in a manner so that they will not in any manner interfere with the vehicular traffic using the county roadway. The material used on the work shall be of standard quality and of adequate size and design to properly meet the local drainage and safety requirements. The ultimate authority on the suitability of materials used, considering the location in which used, shall be the County Road Commissioner. 12.04.040 Sloping away from county roadway¶
required. All connecting roadways, unless otherwise permitted in writing, shall slope away from the county roadway and shall be so constructed as to avoid pocketing or ponding of water. (Ord. 263 § 4, 1951; prior code § 6-2.3).
12.04.050 Damage to shoulders or pavement.¶
Shoulders and/or pavements of the county roads should not be damaged during the construction, maintenance., repair or use of these approaches or connecting roadways. Should damage result to the county road or roads, the permittee shall repair, or cause to be repaired, all damage done and restore the damaged area of the county road or roads to their condition prior to construction, maintenance, repair or use of the approach or approaches, with such repair work to be done within the time limits specified by the grantor. 12.04.060 Use of materials from county¶
roadway prohibited. No materials, earth borrow or otherwise. shall be taken from the county roadway or right-of-way for use in the construction, maintenance, repair or use of these approaches or connections unless prior written approval is received by the permittee, (Ord. 263 § 6, 1951; prior code § 6-2.5).
12.04.070 Maintenance of barriers and signs¶
during construction. During all phrases of construction of any connecting roadway as contemplated by this chapter, the person so constructing the roadway shall cause to be maintained at all times adequate barriers, signs and
lights so that all vehicular traffic traveling the county road is warned of the existence of the construction project. Should the nature of the construction project be such as to require flagmen to adequately insure the protection of the public traveling the county roadway, the person constructing the connecting roadway shall, upon order of the county road commissioner, but at the expense of the permittee, furnish such flagmen in the numbers and for the time required by the county road commissioner. 12.04.080 Violation; enforcement. A violation of¶
this chapter shall be enforced as provided for in Chapter 1.10 of the Tuolumne County Ordinance Code. (Ord. 2296 § 6, 1999).
12.04.090 Enforcement responsibility. The¶
provisions of this chapter shall be enforced by
the County Road Commissioner or their
designee.
