2.44.010 Findings. Whereas, there are in¶
Tuolumne County many persons who have been, and now are, members of the armed services of the United States of America, and Whereas, the number of such persons now returning, and who will return to Tuolumne County, is increasing and will increase in the future; and
Whereas, legislation has been and will be enacted by the United States of America and by the various states of the union, granting to persons who have served in said armed services, and to their families and dependents, the benefits of financial, medical, and other assistance provided by such legislation; and
Whereas, said veterans and their families and dependents need the assistance of trained personnel to obtain for themselves the benefits thus provided for them, and, but for which, they may, or many of them will lose such benefits, and Whereas, by reason thereof, it appears necessary and expedient, and in the public interest, to create in Tuolumne County, an office to be known as the veterans service office, and to provide a veterans service officer therefor; to provide funds for the operation of such office and the payment of salaries and other necessary and proper expenses and charges for the operation and maintenance of such office, and do all things necessary and proper to effectuate this chapter and the purposes thereof. 2.44.020 Office created. Pursuant to Article 4¶
of Chapter 5 of Division 4 of the Military and
Veterans Code there is created in the
government of the county an office to be
knownas the veterans service office. (Ord. 1069
§ 1, 1980; Ord. 513 § 1968; prior code § 3-
2.0).
2.44.030 Definitions. As used in this chapter:¶
A. “Armed services" includes all branches of military service, which are made the subject of legislation by the United States of America, or of any state or territory in the United States, for the purpose of extending to its members, or former members discharged, from such service, any benefits, or services whatsoever.
B. "Veteran" includes any living person, who is serving, or who has served in the armed services, as defined in subsection A, and has been discharged therefrom under conditions other than dishonorable and shall also extend to the families and dependents of any such person, or of any deceased person, who has served therein, or to whom, or to any of whom, there are benefits of any legislation, whether existing at the date hereof, or subsequently enacted, are or have been, or shall be, extended by such legislation. 2.44.040 Vacancy in office - Bond. In the¶
event the position of county veterans service officer is vacated for any reason, the board of supervisors shall obtain a list of candidates, numerically not less than three, who shall be veterans, as that term is defined by Chapter 5, Article (1), Section 980 of the Military and Veterans Code of the state, for the office of veterans service officer. The candidate whom
the board of supervisors deems qualified shall be appointed to such office. The service officer shall, before entering upon the duties of his/her office, take the oath required by law, and when required by the board of supervisors shall furnish a fidelity bond in the sum of two thousand dollars, in favor of the county. The cost of the bond shall be chargeable to the county. (Ord. 513 § 3, 1968; prior code § 3-2.2).
2.44.050 Budget. The veterans service officer¶
shall prepare a budget for each fiscal year to be presented to the board of supervisors, at the proper time and place. (Ord. 513 § 4 (part), 1968; prior code § 3-3.4).
2.44.060 Discharge. The veterans service¶
officer when appointed and qualified as aforesaid shall hold office at the pleasure of the board of supervisors. and shall only be discharged during the term by cause duly shown. (Ord. 513 § 4 (part), 1968; prior code § 3-2.3).
2.44.070 Notice of resignation. The county¶
veterans service officer, in the event he/she desires to resign and vacate his/her office, shall first give notice in writing to the board of supervisors of his/her intention to so resign and to so vacate such office, which notice shall be given not less than thirty days prior to the proposed effective date of such resignation. 2.44.080 Salary. The salary of the veterans¶
service officer is fixed by the board of supervisors payable in equal monthly installments in the same manner as any other county officer. (Ord. 513 § 5, 1968).
2.44.090 Duties. It shall be the duty of the¶
veterans service officer to render all necessary aid and assistance to veterans, as that term is defined in Section 2.44.030 and to their families or dependents, who are entitled to the benefits of any existing legislation, or any legislation or regulation hereafter enacted or promulgated by the United States of America, or any governmental department, thereof, or of the state, or any other state of the United States, to obtain the benefits of such legislation, and to perform such other duties in conformity therewith as directed by the board of supervisors. 2.44.100 Office hours. The veterans service¶
officer shall be responsible to and operate under the direction of the board of supervisors. He/she shall have and maintain an office at a place designated by the board of supervisors and shall have office hours in accordance with directions from the board of supervisors, excepting that nothing in this chapter shall prohibit additional hours if such additional hours shall seem advisable to the veterans service officer or to the board of supervisors. He/she shall hold temporary office in other cities in Tuolumne County, and communities thereof as workload requires and as directed by the board of supervisors. 2.44.110 Records and reports.¶
A. The veterans service officer shall keep records of all business transacted and make a monthly report of disbursements and number of cases pending from the previous month, number of new cases, and number of cases completed, which monthly reports are to be filed in his/her office and such monthly reports shall be available to the board of supervisors, or to any member thereof. He/she shall keep neat, business-like files on all claims, copies of all letters and papers pertaining to such claims which shall be deemed confidential records.
B. The veterans service officer shall compile a yearly report of all his/her activities, travel and expenses; one copy to be presented to the board of supervisors at the time the budget is presented to them, and one copy to be placed on file in his/her office. 2.44.120 Collection of fees or donations¶
prohibited. The veterans service officer shall not collect or receive any fee or donation for services, from any individual except in accordance with the laws of the state and of the United States of America. (Ord. 513 § 8, 1968; prior code § 3-3.5).
2.44.130 Employment of clerical assistants.¶
A. The veterans service officer, with the permission first obtained of the board of supervisors, shall employ such clerical and other assistants as such officer may deem necessary for the proper operation of such office. He/she shall acquire office equipment, with the approval of the board of supervisors first obtained, and do all other and additional things and perform all
other functions required, or permitted, by law for the rendering to veterans, their families and dependents of the maximum assistance by such office.
B. The books, records and files of the veterans service office shall be subject to audit as to fiances as may be ordered by the board of supervisors or as required by law. (Ord. 513 § 9, 1968; prior code § § 3-3.2, 3-3.6).
