8.08.010 Definitions. "Houseboat" as used in this

chapter means any floating platform or boat intended for or capable of being used as a residence, house, dwelling or habitation, and includes any boat equipped with toilet facilities. (Ord. 530 § 2, 1968; prior code § 7-7.0).

8.08.020 Applicability. This chapter shall be

applicable to and govern all public waters including lakes and rivers or portions thereof over which the county has police power jurisdiction, insofar as the provisions of this chapter do not conflict with applicable statutes or regulations of the United States or of the state. 8.08.030 Scope. Sections 8.08.040 through

8.08.070 are for the purpose of adopting regulations governing the use of toilets on houseboats on the public waters of the county. (Ord. 530 § 3 (part), 1968).

8.08.040 Waste discharge prohibited. Discharge

of waste from any source into the public waters of the county is prohibited. (Ord. 530 § 3(a), 1968; prior code § 7-7.2).

8.08.050 Approved toilets. No toilet shall be

installed in any houseboat except of an approved type as follows; Approved toilets are either (1) sanitary toilets of the betaine type whereby the waste is heat treated for sterilization and disintegration or (2) fixed toilets which discharge into a holding tank. Toilets which discharge into a holding tank shall be solidly affixed to the houseboat. They shall have a holding tank of at least fifteen gallons and be so constructed that they can only be emptied by pumping. The holding tank shall be vented to an elevation higher than the toilet fixture and the ventilation line shall not exceed one- half inch standard pipe size. The holding tank on all such toilets shall be pumped when needed and the pumpings deposited in an approved location. (Ord. 530 § 3(b), 1968; prior code 7-7.3).

8.08.060 Toilet inspection. Authorized agents of

the county shall periodically inspect the toilet on each houseboat on the public waters of the county.
The board of supervisors shall establish a fee for such inspection and a sticker shall be issued for display on the houseboat showing that inspection has been made and approval given. (Ord. 530 § 3(c), 1968; prior code § 7-7.4).

8.08.070 Sealing toilet - Fee. Notwithstanding the

provisions of Section 8.08.050, a houseboat having a toilet which permits waste to be discharged therefrom may be permitted upon the public waters of the county when such toilet has been sealed by an authorized agent of the county to render it inoperable. The board of supervisors shall establish a fee for such sealing, and it is unlawful, and a violation of this chapter for any person to wilfully break such seal while Such houseboat is situate on the public waters of the county. (Ord. 530 § 3(d), 1968; prior code § 7-7.5).

8.08.080 Violation; enforcement. A violation of

this chapter shall be enforced as provided for in Chapter 1.10 of the Tuolumne County Ordinance Code. (Ord. 2296 § 6, 1999).

8.08.090 Enforcement responsibility. The

provisions of this chapter shall be enforced by the health department. (Ord. 2296 § 7, 1999).
