9.12.010 Consumption of alcoholic beverages in¶
certain areas prohibited. It is unlawful for any person to have in his/her possession, on his/her person or under his/her control, any bottle, can or other receptacle, containing any alcoholic beverage, as that term is defined in Section 23004 of the Business and Professions Code, which has been opened, or a seal broken, or the contents of which have been partially removed while on any public street, highway, alley, park, grounds, parking lot or sidewalk in any of the unincorporated areas of Tuolumne County described as follows:
A. All that territory in the community of Tuolumne bounded by a northerly right-of-way line of Bay Avenue to its intersection with the easterly right-of-way line of Pine Avenue to its intersection with the southerly right-of-way line of Hodge Alley, to its intersection with the westerly right-of-way line of Oak Street to its intersection with the northerly right-of-way line of said Bay Avenue.
B. All those territories in the community of Jamestown lying within one of the following described boundaries:
Commencing at the intersection of the
north westerly right-of-way of State Highway 108 and the easterly right-of-way of Fifth Avenue, said intersection being the point of beginning, thence southerly along the easterly right-of-way of Fifth Avenue to its intersection with the northeasterly right-of-way of Fifth Avenue South, thence southeasterly along the northeasterly right-of-way of Fifth Avenue South to its intersection with the northeasterly right-of- way Reservoir Road, thence southeasterly along the northeasterly right-of-way of Reservoir Road to its intersection with the easterly right-of-way of Sierra Railroad, thence southerly along the easterly right-of-way of Sierra Railroad to its intersection with the westerly right-of-way of Seco Street, thence northerly along the westerly right-of-way of Seco Street to its intersection with Preston Lane, thence westerly along Preston Lane to its intersection with Highway 108, thence northeasterly to its intersection and alignment with Main Street, thence northerly along the westerly right-of-way of State Highway 108 to the point of beginning. The above described territory shall also include all parking areas lying adjacent to the above described right- of-way lines, where one or more of the above described right-of-way lines borders on the parking area. Excepting from the above- described territories is all that property owned by the state of California and is commonly known as Railtown State Park;All that area known as Patterson Field;
All that area known as Jamestown Elementary School.
C. All that territory known as the Rainbow Pools Day Use Area of the South Fork of the Tuolumne River, being that portion of the east 2 of the southeast 3 of Section 29, T. 1 S., R. 18 E., Mount Diablo Base and Meridian, lying southerly of State Highway 120, in the unincorporated area of Tuolumne County, State of California. The Rainbow Pool Day Use Area is accessed off State Highway 120 by way of Forest Road 1S28, also known as Old Big Oak Flat Road and is within the Stanislaus National Forest. The Rainbow Pools Day Use Area can also be found on portions of Assessor Parcel Numbers 068-150-01, 068-150-02, and 068- 140-17. 9.12.020 Violation an infraction. Pursuant to¶
Section 25132 of the Government Code, violation of this chapter is an infraction, punishable as set forth in said Section 25132. (Ord. 1769 § 1 (part), 1990).
9.12.030 Exemptions. This chapter shall not¶
apply to persons attending fund-raising activities sponsored by civic, charitable or religious
organizations, provided that the proceeds from such activities do not inure to the benefit of any private person, firm or corporation and, further provided, that a permit for such activity is first obtained from the County’s Risk Manager or his/her designee. The County’s Risk Manager or his/her designee may attach conditions to the permit to insure that the purpose of this chapter is maintained at such activities.
