15.36.010 Purpose. This chapter establishes

standards and regulations for the timely repair or demolition of buildings damaged by fire or other calamity or neglect. These regulations are intended to provide property owners with adequate time to obtain insurance payments or other funding necessary to repair, reconstruct or demolish buildings while minimizing the effects of damaged buildings on other properties.

15.36.020 Applicability. The provisions of this

chapter are applicable to all buildings regulated by the County of Tuolumne which have been damaged by a fire or other calamity or which have been neglected to the point that they are detrimental to nearby properties, notwithstanding Section 15.04.010(F) of this Title and Section 108.2 of the International Property Maintenance Code, referenced in Section 15.04.010(F).

15.36.030 Definitions.

A. “Building” as used in this chapter means any structure having, or intended to have, a roof supported by columns or walls, used or intended to be used for the shelter of or enclosure of persons, animals or property. B. “Visual blight” as used in this chapter means the condition of the exterior of a building which, when viewed from a public right of way, is substantially detrimental to the property of others or substantially reduces the aesthetic appearance of the neighborhood, including, but not limited to, boarded up windows or doors, nonpermanent coverings over the roof or other portions of the building, unpainted, cracking or peeling paint, substantial dry rot, warping, sagging roof, porch or deck, or that is defaced with paint or other material.

15.36.040 Requirement to maintain building.

Any person owning, leasing, occupying or having control of a building subject to this chapter shall maintain the building in a condition so as not to be substantially detrimental to nearby properties in accordance with the following: A. Any building which has been damaged by fire or other calamity so as to cause a visual blight, as determined by the Community Resources Agency Director, shall be repaired to restore the appearance of the building as required to eliminate the visual blight or demolished within eighteen (18) months following the fire or other calamity.
B. Any building which has been neglected so as to cause a visual blight, as determined by the Community Resources Agency Director, shall be repaired to restore the appearance of the building as required to eliminate the visual blight or demolished within eighteen (18) months from the date of notification by the Community Resources Agency.

15.36.050 Time extension. The property owner

and/or other responsible person may request in writing, and the Community Resources Agency Director may grant, an extension of the time limit specified in Section 15.36.040. The property owner may request two (2) extensions of up to six (6) months each. The request shall be accompanied by written or other evidence indicating that the property owner is making a good faith effort to comply with the requirements of this chapter.
Based upon the evidence provided, the Community Resources Agency Director may approve, either in whole or in part, or deny the request.

15.36.060 Violation; enforcement. A violation of

this chapter shall be enforced as provided in Chapter 1.10 of this code, except that the time frames set forth in Sections 15.36.040 and 15.36.050 shall apply to any Opportunity to Correct issued for violation(s) of this chapter.

15.36.070 Enforcement responsibility. The

provisions of this chapter shall be enforced by the Division of Building and Safety of the Community Resources Agency. (Ord. 3274 §2, 2015)
