10.14.010 Prohibition of Use of Emergency¶
Access Roads.
A. Except as provided in subdivision B, no person shall enter, drive a vehicle, or ride a bicycle, on any road, or portion thereof, established by this chapter as an Emergency Access Road within the unincorporated area of the county.
B. This prohibition shall not apply to use of the road for either:
An Emergency.
Maintenance or inspection of the emergency access road, and any associated facilities, by persons authorized by the County Public Works director, or the Fire Prevention Bureau. (Ord. 2526 § 1, 2003).
10.14.020 Definitions. The following definitions¶
shall be used in the interpretation and construction of this Chapter:
A. “Emergency” means an unforseen event, incident or circumstance, or a condition resulting from any of these situations, that causes or threatens loss of life, injury to person or property, or human suffering, which consequence could be reduced by use of an emergency access road. “Emergency” also includes an unforseen event, incident or circumstance that causes traffic congestion or a danger to traffic, which the incident commander determines necessitates use of an emergency access road to relieve that congestion or danger until the cause is eliminated.
B. “Emergency Access Road” means a road specifically identified in Section 10.14.030.
C. “Incident commander” means the senior person assigned to the situation causing the traffic congestion or danger by the law enforcement agency, or other agency, with primary jurisdictional authority over the cause of the traffic emergency.
D. “Vehicle” and “bicycle” have the meaning set forth in the California Vehicle Code. (Ord. 2667 § 4, 2005; Ord. 2603 § 2, 2005; Ord. 2526 § 1, 2003).
10.14.030 Establishment of Emergency Access¶
Roads. An emergency access road is established at the following locations, from and after the date when signs are erected on the road, by the Department of Public Works, giving notice of the road’s status and prohibiting non-emergency use:
A. The portion of the road designated as “Fire Access Road” on the Whispering Woods Subdivision map contained in Subdivision Maps, Volume 13, page 81, of the official records of the Tuolumne County Recorder, commencing at a line located forty feet easterly of the westerly boundary of Lot 25 shown on said subdivision map and extending along said Fire Access Road to a line located one hundred and seventy feet easterly.
