MH-5-6701 - AVAILABILITY OF INFORMATION.
Information and data on a user obtained from reports, surveys, wastewater discharge permit applications, permits, monitoring programs, and the District's inspection and sampling activities shall be available to the public and governmental agencies without notification or restriction unless the user specifically requests and is able to demonstrate to the District's satisfaction that the release of such information would divulge information, processes, or methods of production entitled to protection as trade secrets under State law. The
user must assert any such request at the time of submission of the information or data by including "Confidential Business Information" on each page, document, or other item.

MH-5-6702 - CONFIDENTIALITY OF REPORT.
If the user demonstrates that the District should treat information in a report furnished as confidential, the District shall not make portions of the report that might disclose trade secrets or secret processes available for public inspection. The District shall make such portions of the report available immediately upon request to governmental agencies (including EPA and the State) for uses related to the NPDES or pretreatment program and in enforcement proceedings that involve the user or District.

MH-5-6703 - EXCEPTIONS.
Wastewater constituents and characteristics and other effluent data are not confidential information under this Ordinance and shall be available to the public without restriction.
