Chapter 1 — USE OF COUNTY AUTOMOBILES

2-7000 - ADOPTION OF REGULATIONS.
Pursuant to Section 25305 of the Government Code, provision is hereby made for rules and regulations governing the use of automobiles by County officers and employees and providing penalty procedures in the event of their violation.

2-7001 - USE FOR COUNTY BUSINESS ONLY.
County-owned automobiles shall be used only in the conduct of County business. No County officer or employee shall use, or permit the use of, any County-owned automobile other than in the conduct of County business.

2-7002 - REGULATIONS OF COUNTY ADMINISTRATOR.
The County Administrator shall prescribe rules and regulations subject to the approval of the Board which:
(a)
Define the use of County-owned automobiles which constitutes use in the conduct of County business and distinguish that use from misappropriation for private use.
(b)
Prescribe the procedure for determining and collecting from the officer or employee responsible for misuse the actual costs to the County attributable to misuse of County-owned automobiles and the disposition of those collections.
(c)
Prescribe the records and reports to be kept and made by County departments and department heads relating to the use of County-owned automobiles to the end that misuse may be discovered with a minimum of record keeping.
(d)
Govern the use and storage of County-owned automobiles.

2-7003 - DUTIES OF ADMINISTRATOR AND DEPARTMENT HEADS.
The County Administrator shall administer the provisions of this chapter and the rules and regulations adopted pursuant thereto, except that it shall be the duty of each department head to carry out and enforce this chapter and said rules and regulations within his department.

2-7004 - DISCIPLINARY PROCEDURES: MERIT SYSTEM EMPLOYEES.
Any violation of this chapter or the rules and regulations adopted pursuant hereto by a County officer or employee included in the merit system of this County shall subject the officer or employee to the disciplinary procedures provided by section 2-5004, and the rules and regulations adopted by the Civil Service Commission pursuant thereto.

2-7005 - DISCIPLINARY PROCEDURES: EXEMPT EMPLOYEES.
The County Administrator, on his own initiative, may suspend from County service without pay for a period not exceeding thirty (30) days any officer or employee of this County exempt from the Merit System except officers elected by the people and those department heads listed in section 2-5003 (c) for violating this chapter or the rules and regulations adopted pursuant hereto.
The suspension is valid only if a written notice is served on the officer or employee prior to the effective date of the suspension and a copy of the notice is filed with the Civil Service Commission not later than fifteen (15) days after the effective date of the suspension. The notice shall be served on the officer or employee either personally or by mail and shall include:
(a)
A statement of the nature of the punitive action.
(b)
The effective date of the action.
(c)
A statement of the causes therefor.
(d)
A statement advising the officer or employee of his right to answer within ten (10) days of his receipt of the notice. If the employee requests a hearing in his answer, his answer shall be deemed a grievance to be disposed of in the same manner as grievances of employees included within the Merit System.

2-7006 - DISCIPLINARY ACTION: DEPARTMENT HEADS.
The County Administrator may recommend to the Board the disciplinary action he deems appropriate for any violation of this chapter or the rules and regulations adopted hereto by a department head listed in section 2- 5003 (c).

2-7007 - USE BY PUBLIC ADMINISTRATOR.
The Board may authorize the rental of a County Vehicle to the Public Administrator, on a month to month basis, provided the County is reimbursed for the actual costs of such a rental.
