Chapter 1 — STEEL HULL VESSELS

6-6000 - PERMIT REQUIREMENTS.

Prior to use of any steel hull ferry vessel in the County by:

(a)

Any vehicle and-or equipment with a load exceeding Forty Thousand Pounds (Twenty Tons) gross weight;

(b)

Any vehicle and-or equipment with a wheel base exceeding forty (40) feet, or;

(c)

Any vehicle with a trailer; a special permit shall be from the Highway Department of the Department of Public Works.

6-6001 - MAXIMUM LOAD LIMITATIONS.

(a)

The maximum gross weight for which a special permit may be issued to a vehicle and-or equipment shall be Sixty Thousand Pounds (Thirty Tons).

(b)

The maximum wheel base for which a special permit may be issued to a vehicle and-or equipment shall be Forty-Nine (49) feet.

(c)

Vehicles and-or equipment weighing more than Sixty Thousand Pounds (Thirty Tons) or having a wheel base of over Forty-Nine (49) feet shall under no circumstances be permitted on any steel hull vessel in the County.

6-6002 - WEIGHT CERTIFICATES.

Upon request of the ferry tender, vehicles and-or equipment using steel hull vessels in the County shall be required prior to loading upon the ferry to present a weight certificate showing the actual load weight to be transported.

6-6003 - ADDITIONAL PERSONNEL REQUIRED.

Prior to the loading of any vehicle and-or equipment on a steel hull ferry vessel, the owner or operator of the vehicle and-or equipment shall provide, in addition to the driver, at least one person to assist in the loading and unloading of the vehicle and-or equipment when:

(a)

The vehicle and-or equipment to be loaded has a gross weight of Forty-Eight Thousand Pounds (Twenty- Four Tons) or greater;

(b)

The vehicle and-or equipment to be loaded has a wheel base of Forty (40) feet or greater;

(c)

The vehicle to be loaded has a trailer.

6-6004 - FERRY TENDER DISCRETION.

If within the discretion of the ferry tender conditions are such that loading, operation or unloading of any particular vehicle and-or equipment would be deemed dangerous or unfavorable to safety, the ferry tender shall close the ferry to that particular vehicle and-or equipment.

6-6005 - VIOLATIONS.

It shall be unlawful for any person to violate or refuse to obey any of the foregoing rules and regulations.

6-6006 - PENALTIES.

(a)

Any person or persons who violate, or who shall knowingly aid or abet a violation of any of the provisions of this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of

not more than Five Hundred Dollars ($500.00) or by imprisonment in the County Jail for not more than six (6) months, or by both such fine and imprisonment.

(b)

The provisions of section 1-2002 of this code, which provide for a citation form of arrest, shall be applicable to arrests for any and all violations hereof.
