5-9200 - ENFORCEMENT.
It shall be the duty of the Director of Environmental Health or his designee to enforce the provisions of this division.

5-9201 - RIGHT OF ENTRY.
Whenever necessary to make an inspection to enforce any of the provisions of this division, or whenever the Director of Environmental Health or his designee has reasonable cause to believe that there exists upon any premises any condition which constitutes a violation of the provisions of this division, he may enter such premises to inspect the same or perform any duty imposed upon him by this division. Prior to making such entry, if the premises is occupied, he shall first present proper credentials and obtain consent to enter. If such premises be unoccupied, he shall first make a reasonable effort to locate the owner or other persons having charge or control of the premises and request entry. When requesting consent to enter the premises pursuant to this section, he shall inform the property owner or occupant that he has the right to refuse entry and that in the event such entry is refused, issuance of an inspection warrant by a duly authorized magistrate may be sought. If the owner and/or occupant refuses entry after such request has been made, the Director of Environmental Health or his designee is hereby empowered to seek assistance from any court of competent jurisdiction in obtaining such entry.

5-9202 - VIOLATIONS AND PENALTIES.
Any violation of this division is a public nuisance subject to enforcement under the provisions of Title 8, Division 5, Chapter 6 of this code.

5-9203 - SEVERABILITY.
If any clause, provision, sentence, or paragraph of this division, or the application thereof, is deemed to be invalid as to any person, entity, establishment, or circumstance, such invalidity shall not affect the other provisions of this division which shall remain in effect, and to its end, it is hereby declared that the provisions of this division are severable.
