Chapter 2 — PARKS AND RECREATION COMMISSION

2-3100 - STATEMENT OF PURPOSE.

It is the purpose of this chapter to establish a method and organization for the orderly development and coordination of parks and recreation programs within the County to promote the economic and general well- being of the citizens and residents of the County, all in accordance with the following general policies hereby established for the development of the program:

(a)

The function of the County in the field of parks and recreation shall be limited to development of programs and facilities not feasible for, or not within the proper sphere of activity of, cities, school districts, and other local agencies of the County, together with the general coordination of all other parks and recreation activity within the County.

(b)

The parks and recreation activities of the County shall be limited to the development of facilities and programs of Countywide or regional service.

(c)

The County, through planning, consultation, and other related services that may be requested by local agencies, shall encourage the provision of neighborhood and community recreation activities by cities, school districts, and other appropriate local agencies of the County.

(d)

The County, as a part of its parks and recreation program, shall endeavor to preserve and enhance areas of historic significance and natural beauty within the County.

(e)

The County, through appropriate means, shall cooperate with adjoining counties and with cities within the County in the development of a long-range program of joint planning for parks and recreation facilities location.

(f)

The County shall advocate and promote state and federal participation in the development of a parks and recreation program within the County to the extent that such participation corresponds with the established policies of the County.

(g)

The County shall encourage, cooperate with, and plan for sound private development of parks and recreation facilities within the County in order fully to meet the need for parks and recreation facilities within the County.

2-3101 - DEFINITIONS.

As used in this chapter the following words shall have the following meanings:

(a)

"Cities" means all the incorporated cities within the County.

(b)

"Commission" means the Parks and Recreation Commission of the County.

(c)

"Department" means the Department of General Services - Parks and Recreation of the County.

(d)

"Park Administrator" means the Administrator of Parks and Recreation of the County.

(e)

"Director" means the Director of the General Services Department of the County.

(f)

"Assistant Director" means the Assistant Director of the General Services Department of the County.

2-3102 - COMMISSION ESTABLISHED.

There is hereby created and established as a part of the government of the County a commission consisting of seven (7) members to be known as the Parks and Recreation Commission of the County of San Joaquin.

2-3103 - APPOINTMENT OF MEMBERS.

The members of the Commission shall be appointed by the Board of Supervisors.

2-3104 - METHOD OF SELECTION.

At least one member of the Commission shall reside in each of the supervisorial districts of the County. The Board of Supervisors shall select two additional members at large who shall reside within the County.

2-3105 - EX-OFFICIO ADVISORY MEMBERS OF THE COMMISSION.

A member of the Board of Supervisors selected by the Chairman of the Board, the Director of General Services, or his or her designee and County Counsel or his or her designee shall serve as ex-officio advisory members of the Commission. The ex-officio advisory members of the Commission shall not make motions, offer resolutions, or vote as members of the Commission, but they may participate in Commission discussion. The ex-officio advisory members of the Commission shall not receive compensation for their services with the Commission other than the compensation to which they are otherwise entitled as County officers or employees.

2-3106 - LAPSE OF MEMBERSHIP.

The office of any Commissioner shall become vacant if he or she is absent from two (2) consecutive regularly scheduled meetings unless the absences are due to circumstances beyond his or her control or are excused by order of the Board of Supervisors.

2-3107 - COMPENSATION OF MEMBERS.

Each member of the Commission shall receive his or her actual and necessary expenses incurred in the performance of his or her duties, including but not limited to mileage to and from the meetings of the Commission.

2-3108 - TERM OF MEMBERS.

The members of the Commission shall serve for four-year terms. However, the Commissioners first appointed shall serve the following terms: one Commissioner for a term of one (1) year, two (2) Commissioners for a term of two (2) years, two (2) Commissioners for a term of three (3) years, and two (2) Commissioners for a term of four (4) years. The Commissioners first appointed, at their first meeting, shall decide by lot which of them shall serve these terms. Thereafter, members of the Commissioners shall be appointed for terms of four (4) years, except that in the event of a vacancy in office the Commissioner appointed to fill the vacancy shall serve for the unexpired term to which he is appointed.

2-3109 - ORGANIZATION OF COMMISSION.

The members of the Commission, at the time of their initial appointment and annually thereafter during the month of January, shall select from among their members a Chairman and a Vice-Chairman. The Park Administrator or his/her designee shall serve as Secretary to the Commission and shall attend all meetings of the Commission.

2-3110 - RULES.

The Commission shall adopt reasonable rules for the conduct of its meetings.

2-3111 - MEETINGS.

The Commission shall meet at least four times in each calendar year. The Commission shall establish regular meeting dates and from time to time may call special meetings in accordance with the law.

2-3112 - QUORUM.

Four (4) members shall constitute a quorum for the transaction of all business of the Commission, but a lesser number may adjourn from time to time.

2-3113 - ADVISORY POWERS.

The Commission shall have advisory powers only and all actions and recommendations of the Commission, other than matters relative to the internal operation of the Commission, shall be subject to final approval of the Board of Supervisors.

2-3114 - POWERS AND DUTIES OF THE COMMISSION.

The Commission shall do the following:

(a)

The Commission shall, either at the request of the Board of Supervisors or upon its own initiative, study and investigate matters of concern to the County in the field of parks and recreation and make recommendations thereon to the Board of Supervisors. Such matters shall include, but are not limited to, the following:

The acquisition and development of park sites.

The institution of programs of recreation within the County.

The institution of programs to protect and enhance the recreational potential of the County.

The institution of programs to protect and enhance areas of historic significance and scenic beauty within the County.

The protection and enhancement of the recreational potential of the Sacramento-San Joaquin Delta.

All programs of the United States of America, the State, and other agencies outside the County, which relate to or affect parks and recreation within the County or within the region of which the County is a part.

Cooperation by the County with other agencies, counties, and cities within and without the County for the purposes of coordinating recreational development and park site locations throughout the region.

The development of private recreation activities within the County.

The equitable and sound financing of desired parks and recreation programs.

The preservation of open spaces in the vicinity of the urban areas of the County.

Water quality and water pollution as they relate to the recreational use of water within the County and throughout the region.

Ordinances designed to promote the safe, sane, and equitable use of all parks and recreation facilities owned, operated, or controlled by the County.

(b)

The Commission shall plan jointly with the Park Administrator regarding long-range goals for Parks and Recreation. The Park Administrator shall share the long-range goals with the Director and County Administrator and submit it to the Board of Supervisors for final approval.

(c)

The Commission and the Park Administrator shall confer and cooperate with the Advisory Water Commission and the Flood Control Engineer of the San Joaquin County Flood Control and Water Conservation District. In all matters relating to water supply, water use, water conservation, flood control, water pollution, and water quality, as those matters affect or relate to parks and recreation on an as-needed basis.

(d)

Once per calendar year either the Chairman or the Park Administrator shall report to the Board of Supervisors or the ex officio members on all of the activities of the Commission during the preceding year.

2-3115 - PARKS AND RECREATION ADMINISTRATOR AND DEPARTMENT.

The Director may appoint a Park Administrator and such assistants and clerical help as deemed necessary from time to time for the carrying on of a parks and recreation program. The Park Administrator shall serve at the pleasure of the Director or his/her designee and shall, subject to the direction of the Director, administer all parks and recreation facilities and programs of the County.

2-3116 - CONFORMITY TO POLICIES.

In implementing and carrying out all duties assigned to the Park Administrator, the Department, and the Commission shall carry out and implement the policies of the Board of Supervisors as stated in Section 2- 3100.
