MH-4-1300 - FEES AND PERMITS.

(a)

The Board may adopt a schedule of fees for the use of parks. The General Manager may deny a permit on the basis that the applicant does not meet the requirements of the rules and regulations, or past performance indicated noncompliance with park rules and regulations, or on the basis that the proposed use is injurious to the public safety, peace, and enjoyment of the park. An applicant for a permit may appeal the denial thereof to the Board. The determination by the Board shall be final. When such fee schedule or permits are adopted, it shall be unlawful to be in a park except by payment of the fee or in accordance with the required permit.

(b)

The General Manager shall not issue a permit until proof of any required insurance is provided that is consistent with Board ordinances, rules, and policy. The insurance shall name the MHCSD, its officers, agents and employees as additional insured, be primary coverage and indemnify the MHCSD, its officers, agents and employees for any and all losses including, but not by way of limitation, attorney's fees and legal cost that the MHCSD, its officers, agents and employees may suffer by use of the permit.
