2-2500 - DELEGATION OF CERTAIN FUNCTIONS OF PROBATION OFFICER TO DISTRICT ATTORNEY.

The functions of the Probation Officer authorized by Section 580 of the Welfare and Institutions Code and required by Sections 1685 to 1687, inclusive, of the Code of Civil Procedure are hereby delegated to the District Attorney.

2-2501 - IMPOSITION OF SERVICE CHARGE TO PAYMENTS UNDER SECTION 580 OF THE WELFARE AND INSTITUTIONS CODE AND SECTION 4702 OF THE CIVIL CODE.

There is hereby imposed a service charge to defray the cost of services of the District Attorney, when he is designated to act as trustee, in the amount of two percent (2%) of the amount collected in addition to any payments made under Subsections (a), (c), (d) or (f) of Section 580 of the Welfare and Institutions Code and under Section 4702 of the Civil Code. Said service charge is imposed pursuant to and under the conditions of Section 580.5 of the Welfare and Institutions Code.

2-2502 - DISTRIBUTION OF FUNDS OBTAINED FROM SALE OF PROPERTY SEIZED DURING CRIMES INVOLVING CONTROLLED SUBSTANCES.

Pursuant to California Health and Safety Code Section 11489, the District Attorney of the County of San Joaquin or his designee may determine the eligibility of and direct the Auditor-Controller to make payment of moneys generated from the seizure and sale of property used in crimes involving controlled substances. Disbursement of said moneys shall not exceed five percent (5%) of the amount collected. The criteria for the distribution of such moneys shall be:

(a)

Payment may be made to eligible nonprofit organizations which were established for the purpose of providing information aiding such seizures and forfeitures.

(b)

Moneys so paid to said organizations shall be used by said organization to fund their operation for said purpose.

(c)

No funds shall be so disbursed until it has been determined that the information provided by a particular organization resulted in the seizure or forfeiture.

(d)

The amount of money to be paid to eligible nonprofit corporations shall be as determined by the District Attorney of the County of San Joaquin but in no event shall it be more than five percent (5%) of the amount of such funds.
