Chapter 2 — UNCLAIMED PROPERTY

2-7100 - HOLDING PERIOD.

Unclaimed property except unclaimed bicycles and toys shall be held by the Sheriff for a period of at least four (4) months, and unclaimed bicycles and toys shall be held for a period of at least three (3) months.

2-7101 - SALE AT AUCTION.

After the expiration of a period of four (4) months, except that in the case of unclaimed bicycles and toys, after the expiration of a period of three (3) months, from the time unclaimed property has come into the possession of the Sheriff, it may be transferred to the Purchasing Agent for sale to the public at public auction. Any property remaining unsold after being offered at public auction may be destroyed or otherwise disposed of by the Purchasing Agent. If property is transferred to the Purchasing Agent pursuant to this section, the property shall not be redeemable by the owner or other person entitled to possession.

2-7102 - NOTICE OF SALE; DISPOSITION OF PROCEEDS.

Notice of sale shall be given by the Purchasing Agent at least five (5) days before the time fixed therefor by publication once in a newspaper of general circulation published in the County. Proceeds of sale as hereinbefore provided shall be deposited in the treasury of the County. It is hereby declared to be a misdemeanor for the Sheriff or any member of his staff or for the Purchasing Agent or any member of his staff to purchase any property at any sale held under the provisions of this chapter.

2-7103 - UNCLAIMED BICYCLES AND TOYS.

Pursuant to Section 516 of the Welfare and Institutions Code, any bicycles or toys in the possession of the Sheriff which have been unclaimed for a period of three (3) months may, instead of being transferred to the Purchasing Agent for sale to the public at public auction, be turned over to the Probation Officer or to the Department of Public Assistance for use in any program of activities designed to prevent juvenile delinquency.
