2.98.010 - Establishment; appointment of director; staff.

Pursuant to Family Code section 17304, effective December 28, 2001, there is hereby established the department of child support services that is separate and independent from any other county department. The director of the department of child support services shall be appointed by the board of supervisors in accordance with the qualifications established by the State Department of Child Support Services and Family Code Section 17304. The director shall serve at the pleasure of the board of supervisors. Department personnel shall include the officers and employees transferred to it under Section 2.98.030.

2.98.020 - Duties of the department.

The department shall be responsible for promptly and effectively establishing, modifying and enforcing child support obligations, including medical support, enforcing spousal support orders established by a court of competent jurisdiction, determining paternity in cases of a child born out of wedlock, including all other responsibilities set forth in or delegated to a local child support agency pursuant to Division 17 (commencing with Section 17000) of the Family Code. No other local agency shall have any authority over the department as to any function relating to its Title IV-D operations.

2.98.030 - Transfer of functions.

All Kern County programs, employees and other personnel who perform child support collection and enforcement services in the district attorney's office, as well as all assets dedicated to those programs or services in the Family Support Division of the district attorney's office, shall be transferred from the district attorney's office to the department of child support services in accordance with the provisions of Family Code Sections 17304 and 17305. The transfer of programs, services, staff and assets shall be effective December 28, 2001.
