2.88.010 - Established.¶
There is created and established the Kern County solid waste hearing panel. This panel is established in accordance with Chapter 4, Article 2 (commencing with Section 44308) of the Public Resources Code, and the applicable provisions of the California Code of Regulations.

2.88.020 - Membership and selection.¶
The membership panel shall be appointed by the chairman of the board of supervisors and consist of the following members:
A. One member of the board of supervisors;
B. One member shall be a technical expert with knowledge of solid waste management methods and technology;
C. One member shall be a representative of the public at large.

2.88.025 - Term of office.¶
Each member shall serve for a term of four (4) years, and may not serve more than two (2) consecutive terms. If a panel member is unable to serve out his term, the chairman of the board of supervisors shall appoint a replacement to serve out the remainder of the unexpired term. Any member whose term has expired shall continue to serve as a member until a successor has been appointed and qualified.

2.88.030 - Organization.¶
A. Quorum. The panel shall only act as a three (3) member panel for the transaction of its business. Provided that three (3) members are present, the panel shall act according to the vote of the majority of its members.
B. Minutes. The clerk of the board of supervisors shall keep written minutes of its hearings, a copy of which shall be filed with the environmental health services division.
C. Hearings. The panel shall conduct hearings as often as may be necessary for the transaction of business. All proceedings and hearings shall be conducted as provided for in Chapter 4 (commencing with Section 44300) of the Public Resources Code and applicable provisions of the California Code of Regulations. All meetings of the panel shall be subject to the Brown Act.
D. Staff Assistance. The director of environmental health services Division or his/her designee shall furnish the panel with such clerical, administrative, and other personnel as deemed necessary by the panel in order to perform its duties and responsibilities.

2.88.040 - Duties and responsibilities.¶
The panel shall hear and determine appeals by the solid waste facility operators or permit applicants on the rulings, decisions and determinations of the local enforcement agency on permit conditions or the denial, suspension and revocation of permits. All proceedings and hearings before the panel shall be conducted as provided for in Chapter 4, Article 2 (commencing with Section 44300) of the Public Resources Code and applicable provisions of the California Code of Regulations.
