2.131.010 - Electronic filing of documents.

Any elected officer, candidate, committee or other person required by Chapter 4 (commencing with Section 84100) of Title 9 of the California Government Code, also known as the Political Reform Act, to file specified statements, reports, or other documents with the Elections Division of the auditor-controller-county clerk's office and that has received contributions or made expenditures of two thousand dollars ($2,000.00) or more in a calendar year, may electronically file such documents using the auditor-controller-county clerk's online system according to procedures established by the auditor-controller-county clerk.

2.131.020 - Electronic filing of documents by elected officials required.

Elected officials of the county of Kern, including the assessor, auditor-controller, district attorney, sheriff, treasurer-tax collector, and members of the board of supervisors, shall electronically file such statements using the auditor-controller-county clerk's online system according to procedures established by the auditor-controller-county clerk beginning with statements due on or after December 31, 2017. The requirement of this section shall not apply to an elected official who receives contributions totaling less than two thousand dollars ($2,000.00) and makes expenditures totaling less than two thousand dollars ($2,000.00) in a calendar year.

2.131.030 - Digital signature.

Documents submitted electronically using the auditor-controller-county clerk's online system shall be signed digitally under penalty of perjury.

2.131.040 - Future filings.

To ensure reporting continuity, once a statement, report or other document is filed electronically on behalf of any elected officer, candidate, committee, or other person as set forth in Section 2.131.010 above, all future statements, reports, and other documents on behalf of that officer, candidate, committee, or other person shall be filed electronically using the auditor-controller-county clerk's online system. The requirement of this section shall not apply to an elected officer, candidate, committee, or other person who receives contributions totaling less than two thousand dollars ($2,000.00) and makes expenditures totaling less than two thousand dollars ($2,000.00) in a calendar year.

2.131.050 - Paper filing not required.

Any elected officer, candidate, committee, or other person who has electronically filed a statement, report, or other document using the auditor-controller-county clerk's online system is not required to file a copy of that document in paper format with the auditor-controller-county clerk.

2.131.060 - Effect of electronic filing.

Filings made electronically using the auditor-controller-county clerk's online system are the filings of record for the county.

2.131.070 - Paper filing when electronic document not accepted.

If the auditor-controller-county clerk's online system is not capable of accepting a unique type of statement, report, or other document, an elected officer, candidate, committee, or other person shall file that document in paper format with the auditor-controller-county clerk elections division.
