2.26.010 - Name of department.¶
The fire department of the county is designated as, and shall hereafter be known as, the "Kern County fire department."

2.26.020 - Functions.¶
All fire prevention and suppression services within the purview of the functions of the county shall be performed by said department except as otherwise particularly provided by law. The duty to enforce applicable fire codes within the area as defined in the memorandum of understanding between the city of Bakersfield and the county of Kern, Agreement No. 85-215, shall be assumed by the fire agency with jurisdictional responsibility. Such enforcement shall be under the supervision of the chief of the fire department within such jurisdictional responsibility.

2.26.030 - Chief.¶
In the performance of any duty or in the exercise of any authority under the provisions of this section, the chief of the county fire department shall act as the head of a department of the county. The chief is appointed by and serves at the pleasure of the board of supervisors. The administrative direction of all fire prevention and suppression services within the purview of the functions of the county shall be vested in the chief of the county fire department. Any duty or obligation delegated to or imposed upon a county fire warden and/or any authority vested in a county fire warden shall be assumed, performed and exercised by the chief of the county fire department. It is hereby expressly provided that the provisions of this section shall not be construed as the appointment of a county fire warden under the provisions of Section 24008 of the Government Code of the State of California.

2.26.040 - County enforcement.¶
The fire department of the county shall be responsible for the implementation and enforcement of Chapter 6.95, commencing with Section 25500, of Division 20 of the California Health and Safety Code in those areas for which the county fire department has responsibility pursuant to Joint Powers Agreement No. 80-70.

2.26.050 - City enforcement.¶
The fire department of the city of Bakersfield shall be responsible for the implementation and enforcement of Chapter 6.95, commencing with Section 25500, of Division 20 of the California Health and Safety Code in those areas for which the city fire department has responsibility pursuant to Joint Powers Agreement No. 80-70.

2.26.060 - Emergency services director.¶
The fire chief shall also serve as director of emergency services and vice-chairman of the Kern County emergency council. The fire chief shall be responsible for the coordination of planning and control of declared emergency response activities within Kern County pursuant to Chapter 2.66 of this code.
