INTEGRATED WASTE MANAGEMENT FUND

There is hereby created and established a separate fund entitled the "integrated waste management fund."

4.80.3060 Deposit of moneys. ¶
There shall be deposited in the integrated waste management fund:
A. All moneys received from residential solid waste generators as payment for services under the Recycle Plus! Integrated Waste Management Program.
B. All source reduction and recycling fees.
C. All payments received from the agreement between the City of San José and Waste Management of California, Inc., for collection of solid wastes.
D. All payments received from any person who has entered into an agreement with the city for the designation of such person as a "designated hauler" of solid wastes for the purposes of disposal at Newby Island under the city's allocation quantity, as described in the agreement between the City of San José and International Disposal Corporation for disposal of municipal solid waste.
E. Such other moneys as the city council may transfer from other funds.

4.80.3070 Crediting of interest. ¶
All interest payments and other returns on investment of moneys in the integrated waste management fund shall be deposited in and credited to the fund. The city council may only transfer such interest and other returns on investments to the general fund or to such other fund of the city as determined by the city council if such transfer is consistent with state law. The city council may only transfer moneys in the integrated waste management fund to the general fund or to such other fund of the city as determined by the city council if such transfer is consistent with state law.
