4.32.010 Conditions for entering agreements - City council authority. ¶
The City of San José shall not enter into any agreement creating any entity which shall have the power to issue revenue bonds (or which gives to any entity already created the power to issue revenue bonds), pursuant to Chapter 5 of Division 7 of Title 1 of the Government Code of the state, unless prior to entering into any such agreement the city council first determines by the affirmative vote of at least five members of the council that the public interests and necessity demand that the entity acquire or construct or maintain or operate the proj-

ect which such agreement would give the entity the power to acquire or construct or maintain or operate; and the city shall not authorize any such entity to exercise the power to issue such revenue bonds pursuant to said Chapter 5 unless prior to authorizing the exercise of such power the city council first determines by the affirmative vote of at least five members of the council that the public interest and necessity demand that the entity exercise such power. The provisions of this section shall not apply to any entity which was in existence and had the
