Chapter 3 — DEPARTMENT OF PUBLIC WORKS

Sec. 7-3.01. - Created: Director: Position of created.¶
There is hereby created in the County a Department of Public Works, which shall be known as the "Department of Public Works", and the position of Director of the Department of Public Works, who shall be known as the "Director of the Department of Public Works".

Sec. 7-3.02. - Duties.¶
Under the supervision of and subject to the discretion of the Board, the duties to be performed by the Department of Public Works shall be as follows:
(a)
To supervise, prepare, or approve the design, plans, location, specifications, estimates, and right-of-way matters for all roads, bridges, and County buildings.
(b)
To handle all matters relating to contracts for the construction of roads, bridges, and all other public works as may be directed by the Board.
(c)
To represent the County before any governmental agency or body on matters relating to roads, bridges, and all other public works.
(d)
To handle all technical matters pertaining to subdivisions.
(e)
To perform all surveying and mapping as required by law.
(f)
To handle all matters pertaining to County service stations and garages.
(g)
To handle all matters pertaining to the National Flood Insurance Program as required by law or County ordinance.
(h)
To perform all of functions of the Road Department. The Director of Public Works is also authorized to perform the duties of the Road Commissioner, as provided for herein or by law.
(i)
To perform all of the duties of the County Surveyor-Engineer as provided by law.
(j)
To cooperate with the Department of Water Resources of the State through the exchange of basic engineering data and for any other services which might be required in the best interests of the County.
(k)
To handle all matters relating to the operation and maintenance of the County road system.
(l)
To handle all matters relating to the operation and repair of Department of Public Works and Road Department equipment and the administration of the County shops.
(m)
To perform any and all activities and duties which may be ordered by the Board.

Sec. 7-3.03. - Director: Qualifications.¶
The Director of the Department of Public Works shall possess a general knowledge of public or business administration and a particular knowledge of public works administration. Pursuant to California Street and Highway Code Section 2006.6, the Board of Supervisors hereby abolishes the Office of the Road Commissioner and transfers all duties of the Road Commissioner to the Director of the Department of Public Works. The Director of the Department of Public Works shall not be required to have any special permit, registration, or license. Any civil engineering functions that are required to be performed by the Road Commissioner shall be performed by a registered civil engineer acting under the authority of the Director of the Department of Public Works.

Sec. 7-3.04. - Director: Appointment and removal.¶
The Director of the Department of Public Works shall be appointed by a majority of the members of the Board. He shall serve at the pleasure of the Board and may be removed or suspended by a majority vote of the Board at any regular meeting; provided, however, the Director of the Department of Public Works shall have not less than thirty (30) days' notice in writing of the Board's intention to remove him before his removal shall become final. During such thirty (30) day period, he may be suspended or relieved of his duties by a majority vote of the Board.

Sec. 7-3.05. - Limitations of authority.¶
The provisions of this chapter shall not be deemed or construed to grant any authority to, or impose any duty upon, the Department of Public Works and/or the Director of the Department of Public Works which authority or duty is vested or imposed by general law in or on any other County officer, board, commission, department, or employee.
