Article 2 — Noncommercial Weighing and Measuring Instruments

Sec. 6-7.2.01. - Purpose and authority.

The purpose of this article is to establish a system to recover the costs of inspecting and testing noncommercial weighing and measuring instruments pursuant to Section 12210(b) of the Business and Professions Code. The authority for this article is Article 2.1 (commencing with Section 12210) of Chapter 2, of Division 5 of the Business and Professions Code.

Sec. 6-7.2.02. - Definitions.

For the purpose of this article, unless the context otherwise requires:

"Location" means the room, enclosure, building, space or area where one or more weighing or measuring devices are located or operated.

"Noncommercial purposes" means and includes the determination of the weight, measure, or count of any commodity or thing which is not sold or a determination upon which no charge for service is based.

"Person" shall have the meaning assigned to it by Section 12011 of the Business and Professions Code.

"Sealer" means the sealer of the Weights and Measures Division and his duly authorized agents.

"Weighing and measuring instruments" means "weighing instruments" and "measuring instruments" as defined by Section 12500 of the Business and Professions Code.

"Weights and Measures Division" means the Weights and Measures Division of the Siskiyou County Department of Agriculture.

Sec. 6-7.2.03. - Inspection of noncommercial devices.

The sealer shall, and only upon the written request of any person, firm or corporation, calibrate, test, weigh and measure, and certify to the accuracy of noncommercial weights and measures and weighing and measuring devices, and instruments, tools, and accessories connected therewith.

Sec. 6-7.2.04. - Fees.

The sealer may charge the requesting owner or user a fee for the inspection of noncommercial weighing and measuring devices. The fees shall be as follows:

Small Capacity Scales $85.00/hr + $1.50/mile (up to 10,000 GVW)

Large Capacity Scales $100.00/hr + $2.00/mile (10,000 to 40,000 GVW)

All scales exceeding 3,000 lbs. Capacity $130.00/hr + $2.50/mile (more than 40,000 GVW)

Retail Gasoline Dispensers $70.00/hr + $0.75/mile

Wholesale Petroleum Meters $70.00/hr + $1.00/mile

Liquified Petroleum Gas Meters $70.00/hr + $$.85/mile

All Other Commercial Devices $70.00/hr + $1.00/mile
