Article 5 — Home Incarceration Program

Sec. 2-31.5.01. - Purpose.¶
There is hereby established a Sheriff's Home Incarceration Program. Such program shall maintain the highest public confidence, credibility and public safety.

Sec. 2-31.5.02. - Authority.¶
Penal Code Section 1203.16 authorizes the Board of Supervisors to authorize the Sheriff to offer a program under which minimum security inmates and low-risk offenders committed to a county jail or other county correctional facility or granted probation, or inmates participating in a work furlough program, may voluntarily participate in a home detention program during their sentence in lieu of confinement in the County Jail or other correctional facility or program under the auspices of the probation officer.

Sec. 2-31.5.03. - Rules and regulations.¶
The Board of Supervisors may prescribe rules and regulations under which the home detention program may operate. The rules and regulations shall be written and reviewed on an annual basis by the County Board of Supervisors and the Sheriff. The rules and regulations shall be given to or make available to any participant in the program upon request.

Sec. 2-31.5.04. - Program administrative fee.¶
Penal Code section 1203.016 authorizes the setting of a program administrative fee to be paid by each home detention participant. The fee shall be determined according to the participant's ability to pay. Inability to pay all or a portion of the program fee shall not preclude participation in the program and eligibility shall not be enhanced by the ability to pay. All program administration and supervision fees shall be administered in compliance with Section 1208.2 or any successor thereto.
The program fee is hereby set as follows:
(a)
A nonrefundable one time set up fee of Forty and no/100ths ($40.00) Dollars payable prior to acceptance into the program;
(b)
A daily administrative fee of Twelve and 50/100ths ($12.50) Dollars per day for each program day to defray equipment lease and administrative costs.
The Sheriff shall have the option to waive the fees for program supervision when deemed necessary, justified, or in the interest of justice.
All fees paid by persons for program supervision shall be deposited into the general fund of the County.

Sec. 2-31.5.05. - Program administrator—Probation Department.¶
The Siskiyou County Board of Supervisors hereby designates the Siskiyou County Chief Probation Officer as the Administrator of the Home Incarceration Program with respect to program participates under the control and supervision of the Siskiyou County Probation Department. The Probation Officer shall assume all the duties and obligations formerly undertaken by the Sheriff in the administration of said Program but only with respect to participants of the program who may be under the control and supervision of the Siskiyou County Probation Department.
