Article 14 — Animals at Large

Sec. 5-3.14.01. - Dogs at large.

No person owning, having charge, care, control or custody at any time shall permit, allow, or cause any dog owned, controlled, harbored, or kept by him to roam, run, or stray away from the premises where such dog is kept or harbored, except in the company or custody and under the control of the owner or some responsible person.

No person at any time shall allow, permit, or cause any dog to run on the land of another without the permission of the owner or person in possession of such land. Dogs which are being used for the movement of livestock or other farm-related duties and dogs, which are being used lawfully in the pursuit of game animals or birds shall be considered under the control of the owner or other responsible person. The requirements of this section shall be in addition to all other restrictions applying to dogs and the owners of dogs within the County, and any violation of the provisions of this section shall be a misdemeanor with a minimum fine of Fifty and no/100ths ($50.00) Dollars and may result in the impounding of the dog.

Sec. 5-3.14.02. - Stallions at large.

No person shall permit or allow uncastrated domestic horses or burros to run at large, including, but not limited to, open range areas.

Sec. 5-3.14.03. - Exotic animals at large.

No person shall permit or allow any exotic animal such as, but not limited to, llamas, ostriches and emus to run at large.

Sec. 5-3.14.04. - No buffalo at large; Brucellosis free.

(a)

No person shall permit or allow any number of American Bison (Buffalo) to run at large.

(b)

All owners of American Bison (Buffalo) shall ensure that their animals are free of Bovine Brucellosis.

Sec. 5-3.14.05. - Violations; Penalties.

In addition to any other fines and penalties provided by this Code or State law, violations of Section 5- 3.14.04(a) shall result in a fine as follows (regardless of the number of animals that may be involved in any single violation):

(a)

First violation: One Hundred and no/100ths ($100.00) Dollars;

(b)

Second violation: Two Hundred Fifty and no/100ths ($250.00) Dollars;

(c)

Third and subsequent violations: Five Hundred and no/100ths ($500.00) Dollars per occurrence.
