Sec. 2-37.01 - Department established—Director created.

There is hereby created as a County Department a Health and Human Services Agency and the position of Director of Health and Human Services. The Director of the Health and Human Services Agency shall be an at will employee appointed by the Board of Supervisors.

Sec. 2-37.02 - Agency duties.

Under the supervision of the Board of Supervisors, and subject to the discretion of the Board of Supervisors, except as otherwise provided by applicable law, the Health and Human Services Agency shall perform all of the duties of the Department of Behavioral Health, the Department of Human Services and the Department of Public Health; including personal Health; jail inmate health and emergency services as required by applicable County, State of California and Federal laws, rules and regulations.

The Director of the Health and Human Services Agency shall perform all duties of the Director of Human Services and the Director of Behavioral Health and the Director of Public Health as otherwise provided by ordinance or law.

Sec. 2-37.03 - Intent.

It is the intent of the Board in creating the Health and Human Services Agency to provide for the consolidation and integration of funding, administration and delivery of services and functions of the Department of Human Services, the Department of Behavioral Health Services, and the Department of Public Health under the Director of the Agency. Those duties presently set forth in County law for Human Services and Public Health and Behavioral Health Services are intended to be consolidated under the administrative direction of the Director of the Agency.

Sec. 2-37.04 - Mental health, alcohol and drug services.

The Health and Human Services Agency is authorized to perform all of the duties of the Mental Health, Alcohol and Drug Services programs and services as set forth in Chapter 11 of Title 5 of the County Code.

Sec. 2-37.05 - Consolidation.

Under the supervision of the Board of Supervisors and subject to the direction of the Board of Supervisors, the Director of the Health and Human Services Agency shall proceed with the consolidation of the Agency both structurally and financially as allowed by law. The Director of Health and Human Services Agency is authorized to create an organizational structure for the Agency to meet Agency needs consistent with personnel rules and regulations or as otherwise allowed by local, state or federal law.
