Chapter 11 — PUBLIC ADMINISTRATOR/PUBLIC GUARDIAN

Sec. 2-11.01. - Appointment.

A.

Pursuant to the authority granted by Government Code Section 27430, the office of Public Guardian/Conservator is established within the County.

B.

Pursuant to Government Code Section 24011, the County offices of Public Administrator and Public Guardian/Conservator shall be consolidated into one office to be known as the Public Administrator/Public Guardian/Conservator. The same person shall hold the offices of Public Administrator and Public Guardian/Conservator.

C.

The Director of the Siskiyou County Health and Human Services Agency, with the concurrence of the Board of Supervisors, shall be the appointing authority for the Public Administrator/Public Guardian/Conservator.

D.

The Public Administrator/Public Guardian/Conservator shall be an employee in the Siskiyou County Health and Human Services Agency who shall report directly to the Director of the Health and Human Services Agency.

E.

Except as otherwise specifically provided by law, all authority and responsibility as appointing authority for the Public Administrator/Public Guardian/Conservator is delegated by the Board of Supervisors to the Director of the Health and Human Services Agency.

Sec. 2-11.02. - Authority.

The authority of the Public Administrator/Public Guardian/Conservator shall cease upon the termination of his or her tenure as Public Administrator/Public Guardian/Conservator and authority shall vest in his or her successor.

Sec. 2-11.03. - Letters of guardianship.

If letters of guardianship are to be issued, they may be issued to "the Public Guardian of Siskiyou County." No new letters need to be issued to any successory of the Public Guardian.

Sec. 2-11.04. - Bond.

The Public Guardian shall give an official bond in the amount prescribed by the Board of Supervisors. No bond is required in an individual estate.
