A1-31. - Violation—Infraction.

Except as otherwise provided (and regardless of the availability of other civil or administrative remedies and procedures for enforcing this code), every act or condition prohibited or declared unlawful by this code, and every failure or omission to act as required herein is a violation of this code and is an infraction. A1-32. - Violation—Penalty.

A. Infractions. Except as otherwise provided by statute or this code, every infraction violation of this code is punishable, upon conviction thereof, by: 1. A fine not exceeding one hundred dollars for a first violation; or 2. A fine not exceeding two hundred dollars for a second violation of the same ordinance within one year; or 3. A fine not exceeding five hundred fifty dollars for each additional violation of the same ordinance within one year. B. Misdemeanors. Except as otherwise provided by state law or this code, every misdemeanor violation of this code is punishable, upon conviction thereof, by imprisonment in the county jail for not over six months and/or by a fine of not over one thousand dollars. A1-33. - Violation—Continuing.

Acts, omissions or conditions in violation of this code which continue, exist or occur on more than one day constitute separate violations and offenses on each such day. (Prior code § A1-34)

A1-34. - Violation—Abatement as nuisance.

In addition to the penalty provided, any condition caused or permitted to exist in violation of a provision of the code, whether the violation is an infraction or a misdemeanor, is a public nuisance and may be summarily abated as such. Each day that the condition continues is a new separate offense. (Prior code § A1-41)

A1-35. - Violation—Land use permit or variance.

Each person who holds a land use permit or a variance permit issued by the city and the successor to each such person shall comply with each provision of the permit and with each term which is imposed as a condition to the exercise of the permit. A person who violates or fails to comply with each provision of the permit and with each term imposed as a condition to the exercise of the permit is guilty of a violation of this section. A person who violates this section is guilty of an infraction and shall be punished as provided in Section A1-32 of this article. The penalty provided in this section is in addition to the penalty of forfeiture of the permit prescribed by this code. (Prior code § A1-42)

A1-36. - Arrest authority and procedure.

A. Each officer and employee of the city is authorized to arrest a person for the violation of an ordinance or statute which it is his duty to enforce. B. Procedure for Making Arrests.

  1. The public officer or employee authorized to make an arrest under subsection A of this section may arrest a person without a warrant whenever he has reasonable cause to believe that the person to be arrested has committed a misdemeanor in his presence which is a violation of a statute or ordinance which the public officer or employee has the duty to enforce. 2. In every case where a person is arrested, Chapter 5C of Title 3 (beginning with Section 853.5) of the Penal Code of the state applies with reference to the proceeding.

C. Subsections A and B of this section are adopted under the authority of Section 836.5 of the Penal Code of the state. (Prior code §§ A1-46, A1-47, A1-48)
