B7-300. - Approval of the Policy.¶
The City Council of the City of San Ramon approves the adoption of San Ramon Police Department Policy 708, “Specialized or Military Equipment Policy,” attached and incorporated as Exhibit 1 into this Ordinance. In doing so, the City Council directs that: A. Staff is authorized to request, seek funding, acquire, collaborate with other jurisdictions, and use new or existing military equipment consistent with this Policy. B. Staff shall maintain the Policy on the Police Department’s website page for as long as the military equipment is available for use. C. Pursuant to Cal. Gov’t Code section 7072, the Police Department shall, for as long as the military equipment is available for use:

- submit to the City Council an annual military equipment report, consistent with Cal. Gov’t Code section 7072(a), within one (1) year of Policy approval and every year thereafter; 2. make the annual military equipment report publicly available on the Police Department’s website page; and 3. within thirty (30) days of submitting and publicly releasing the annual military equipment report, hold a publicized community engagement meeting at which the general public may discuss and ask questions regarding the Police Department’s annual military equipment report and the Policy.
D. At least once annually, the City Council shall review this Ordinance, the Policy and the annual military equipment report prepared by the Police Department, pursuant to Cal. Gov’t Code section 7072, and determine by resolution, pursuant to Cal. Gov’t Code section 7071, the following: 1. whether the use of the military equipment in the past year has complied with the Policy; and 2. whether to continue the Ordinance and Policy, or to take action by ordinance to modify such Policy or to repeal the Ordinance. E. Staff shall seek approval from the City Council prior to the acquisition or use of any specialized or military equipment, as defined in Cal. Gov’t Code section 7070, that is not held in the Police Department’s current inventory unless exigent circumstances exist where delaying the acquisition or use of the equipment would jeopardize the safety of the San Ramon Community or members of the Police Department. If such circumstances exist, notification of the acquisition or use of the equipment, including a summary of the exigent circumstances preventing the Police Department from giving prior notice, will be provided to the City Council at the first regularly scheduled public meeting following the equipment’s acquisition or use. F. The Policy shall continue in effect until it is amended or repealed by ordinance of the City Council. (Ord. No. 515, § 2, 05/10/2022)
