A5-91. - Establishment.¶
The city housing authority is established in accordance with Housing Authorities Law of California (Section 34200 et seq. of the Health and Safety Code). (Ord. 207 § 1 (part), 1991)
A5-92. - Duties.¶
The duties of the city housing authority are as follows: A. To assist the city in providing suitable and affordable housing to qualified low-income and moderate income persons; B. To increase communication and understanding with the city, the community, with other governmental agencies, nonprofit housing corporations, volunteer housing groups and individuals working towards the goals of the housing authority; C. To work for funding in conjunction with the city council and the city staff in obtaining resources for low-income and moderate-income programs within the city; D. To file such reports as are required by state and federal laws and regulations and/or resolutions of the city; E. To investigate and support with the city all possible means for developing affordable housing within the city; F. To oversee and assure that the housing needs of the city are fostered by actively participating in the land use and/or housing reviews that are undertaken by the city; G. To cooperate with private housing industry to produce affordable housing; and H. To jointly exercise its powers with local housing agencies, for appropriate programs, in providing affordable housing within the city. (Ord. 207 § 1 (part), 1991)
A5-93. - Board of directors.¶

The board of directors of the city housing authority shall consist of the five members of the city council. All rights, powers, duties, privileges and immunities of the authority, except as otherwise expressly provided by state law or ordinance, are vested in the board of directors. A. The chairperson of the board of directors shall be elected for a term of one year at the same time the mayor and mayor pro tempore are selected by the city council. B. Rules of procedure shall be provided for the conduct of business for the city council, except as specifically provided otherwise of the Housing Authorities Law of California (Section 34200 et seq. of the Health and Safety Code) or by resolution of the board of directors. C. The board of directors shall meet annually between March 1st and June 30th of each year, in the city council chambers, 2222 Camino Ramon, San Ramon, California, to consider the budget. Special meetings may be called as the need arises. D. Special meetings may be called by the chairman or two members of the board of directors and shall be noticed as required by Sections 54950 et seq. of the Government Code, commonly referred to as the Ralph M. Brown Act. The only business transacted shall be limited to terms and subjects set forth in the notice of special meeting. E. The board of directors shall be compensated for all reasonable and necessary expenses incurred in the performance of their duties on behalf of the authority. (Ord. 207 § 1 (part), 1991)
A5-94. - Delegation of authority.¶
All powers of the board of directors are delegated to the housing commission except the following: A. Approval of the annual budget; B. Acquisition of real property; C. Issuance of long-term debt or bonds; D. Appointment of the executive director, legal counsel, treasurer and secretary of the authority; and E. Any other action of the housing commission which is appealed in accordance with Sections A5-103 and A5-104. (Ord. 207 § 1 (part), 1991)
A5-95. - Housing commission.¶
There is established a housing commission for the city housing authority; the numbers of members, terms and the manner of their selection shall be as set forth in Article 3, Part 2, Division 24 of the Health and Safety Code (34270 et seq.). The housing commission shall meet at such times and place as set forth by resolution of the city council. (Ord. 207 § 1 (part), 1991)
A5-96. - Powers of the housing commission.¶
A. The housing commission shall review and make recommendations to the board of directors regarding the following actions: 1. Approval of the annual budget; 2. Acquisition of real property; 3. Issuance of long-term debt or bonds; and 4. Appointment of the executive director, legal counsel, treasurer and secretary of the authority.

B. Except for the actions specifically reserved to the board of directors in Section A5-94, the housing commission shall be empowered to take any action necessary to carry on the business of the housing authority. The powers of the housing commission shall include, but not be limited to, the following: 1. Authorize payment of claims; 2. Enter contracts (including power to hire the exclusive agent for the management of any project owned by the authority); 3. Acquire property other than real property; 4. Make rules, regulations and policies regarding housing authority projects; 5. To enforce rules and regulations; and 6. To adopt and amend the bylaws of the housing authority and select a chairperson and vice chairperson. (Ord. 207 § 1 (part), 1991)
A5-97. - Chairperson and vice chairperson.¶
The officers of the commission shall be a chairperson and vice chairperson. A. The chairperson and vice chairperson shall, at the first meeting of the commission and thereafter at the second meeting in November of each year, select by a majority vote of the commission, a chairperson and vice chairperson for a term of office of one year. B. The chairperson shall preside at all meetings of the commission and the vice chairperson shall perform the duties of the chairperson in the absence of the chairperson, and in the case of the resignation or death of the chairperson, the vice chairperson shall perform such duties as imposed on the chairperson until such time as the commission shall select a new chairperson. C. Should the offices of chairperson or vice chairperson become vacant, the commission shall elect a successor from its membership at the next regular meeting, and such election shall be for the unexpired term of office. A5-98. - Executive director.¶
Until such time as the board of directors by resolution appoint an executive director, the city manager of the city shall be the executive director of the authority. A. The executive director shall have general supervision over the administration of the authority business and affairs, subject to the direction of the board of directors. B. The executive director may employ such personnel as he or she deems necessary to exercise the powers, duties and functions as prescribed by the Housing Authorities Law and all other laws of the state applicable thereto. A5-99. - Authority counsel.¶
Until such time as the board of directors by resolution appoint an authority counsel, the city attorney of the city shall by the counsel of the authority. The authority counsel is authorized to retain such legal specialized services, pursuant to A5-96, as is required to perform the duties of authority counsel. (Ord. 207 § 1 (part), 1991)
A5-100. - Executive secretary.¶

Until such time as the board of directors by resolution appoint an executive secretary, the executive director shall be the secretary of the authority. (Ord. 207 § 1 (part), 1991)
A5-101. - Treasurer.¶
Until such time as the board of directors by resolution appoint a treasurer, the executive director shall be the treasurer of the authority. As treasurer, he or she shall have the care and custody of all funds of the authority and shall deposit the same in the name of the authority in a financial institution authorized by law. He or she shall be bonded for the faithful performance of his or her duties in an amount determined by the board of directors. (Ord. 207 § 1 (part), 1991)
A5-102. - Per diem payments for commissioners.¶
Commissioners shall receive a per diem of fifty dollars for each meeting attended, not to exceed four meetings per month, as authorized by Section 34274 of the Health and Safety Code. In addition, commissioners shall receive necessary traveling and subsistence expenses incurred in the discharge of their duties. (Ord. 207 § 1 (part), 1991)
A5-103. - Appeal from housing commission decisions.¶
A. Any interested person, including any tenant of the housing authority, any city councilmember, any member of the board of directors, any housing commissioner and the executive director, may appeal a decision of the housing commission. B. All decisions of the housing commission shall become final unless appealed within fifteen calendar days from the date of commission action. C. Each appeal shall be submitted in writing to the executive director and shall state the name and address of the appellant, the specific commission being appealed and a summary statement of the facts and reasons in support of the appeal. The appellant may submit an alternative decision. (Ord. 207 § 1 (part), 1991)
A5-104. - Board of director's review.¶
Upon receipt of an appeal, the chairman of the board of directors shall call a noticed special meeting of the board of directors. Normally, the special meeting shall be scheduled to coincide with a regularly scheduled city council meeting. (Ord. 207 § 1 (part), 1991)
