A4-1. - Meetings.¶
A. Regular meetings of the city council shall be held in the City Hall Chambers, 2222 Camino Ramon, San Ramon, California, and shall be held on second and fourth Tuesdays of each month commencing at seven p.m. B. Whenever the day fixed for a regular meeting falls upon a day designated as a holiday, the meeting shall be rescheduled or cancelled. C. If the regular meeting place is unable to accommodate the number of persons in attendance, the council may recess the meeting to another place. If the council anticipates the regular meeting place will be inadequate, the council, or the mayor in the event of an emergency, may order that the meeting be held in another place. D. Special and emergency meetings of the city council shall be called as provided by Sections 54956 and 54956.5, respectively, of the Government Code. (Ord. 341 § 1, 2002; prior code § A4-2) (Ord. A4-2. - Mayor and mayor pro tempore.¶
A. The mayor shall be elected for a two-year term on the first Tuesday following the first Monday of each even-numbered year and shall be limited to such number of terms as are specified in the Charter of the city. The mayor shall be compensated at the rate of one hundred dollars more per month than the compensation set forth for councilmembers and be provided such health and welfare benefits as are provided for the employees of the city under Government Code Sections 53205 and 53205.1 in amounts not to exceed those provided city employees. B. In even-numbered years, the city council shall meet at the regularly scheduled meeting next following the meeting at which the declaration of the election results was made pursuant to Section 10262 or 10263 of the Elections Code and choose one of its members as mayor pro tempore for a one-year term. In odd-numbered years, the city council shall at the first regularly scheduled meeting in November select one of its members as mayor pro tempore for a one-year term. C. The mayor shall preside at the meetings of the council. If he or she is absent or unable to act, the mayor pro tempore shall serve until the mayor returns or is able to act. The mayor pro tempore has all of the powers and duties of the mayor. D. The mayor may make or second any motion and present and discuss any matter as a member of the council. E. The mayor shall be a member of the Contra Costa County city selection committee. F. Pursuant to Government Code Section 3625(b), the mayor may request the Governor to proclaim a state of emergency within the jurisdictional boundaries of the city. G. If the city clerk is absent, the deputy city clerk shall act. If there is none, the mayor shall appoint one of the councilmembers as city clerk pro tempore. H. The mayor shall sign: 1. All warrants drawn on the city treasurer; 2. All written contracts and conveyances made or entered into by the city; 3. All instruments requiring the city seal.

The city council may provide by ordinance that the instruments described in subsections (H)(1)— (H)(3) of this section be signed by an officer other than the mayor. I. Upon being advised of a vacancy on a city commission or committee, the mayor, at the first regular meeting of the city council following such notification, shall direct the city manager to initiate action necessary to timely fill the vacancy by (1) advertising and posting notices announcing the vacancy and inviting qualified applicants to submit applications and (2) bringing the matter back to the city council for its selection of the commission or committee member. J. The mayor, with the consent of the city council, shall make all appointments to committees consisting solely of members of the city council and which are less than a quorum of the city council. K. The mayor, with the consent of the city council, shall make all appointments to area and statewide committees. L. The mayor shall perform such other duties as may be provided for by the laws of the state of California and this code. (Ord. 391 §§ 1, 2, 2007; Ord. 365 § 3 (part), 2004) (Ord. A4-3. - City council.¶
A. The city council shall be elected for four-year terms on elections conducted on the first Tuesday following the first Monday of each odd-numbered year. B. The city council shall hold regular meetings at least once a month at times fixed by ordinance or resolutions. It may adjourn any regular or adjourned meeting to a date specified in the order of adjournment. When so adjourned, the adjourned meeting is a regular meeting for all purposes. C. If a city councilmember is absent without permission from all regular city council meetings for sixty days consecutively from the last regular meeting he or she attended, his or her office becomes vacant and shall be filled as any other vacancy. D. If a vacancy occurs in the city council, the council shall, within thirty days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. The special election shall be held on the next regularly established election date not less than one hundred fourteen days from the call of the special election. A person appointed or elected to fill a vacancy holds office for the unexpired term of the former incumbent. E. At any special meeting, the city council shall act only on matters referred to in the notice or consent. F. When an order of adjournment of a regular meeting fails to state the hour at which the adjourned meeting is to be held, it shall be held at the hour specified for regular meetings. A majority of the council constitutes a quorum for transaction of business. Less than a majority may adjourn from time to time, and compel attendance of absent members in the manner and under the penalties prescribed by ordinance. G. If all councilmembers are absent from any regular meeting, the city clerk shall declare the meeting adjourned to a stated day and hour. He or she shall cause a written notice of the adjournment to be delivered personally to each councilmember at least three hours before the adjourned meeting. H. The council may establish rules for the conduct of its proceedings. It may punish a member or other person for disorderly behavior at a meeting. I. The council shall cause the clerk to keep a correct record of its proceedings. At the request of a member, the city clerk shall enter the ayes and noes in the journal.

J. Each member of the city council shall receive a salary of seven hundred dollars per month and be provided for such health and welfare benefits as are provided for the employees of the city under Government Code Sections 53205 and 53205.1 in amounts not to exceed those provided city employees. The city council salary shall be increased by five percent every other year on December 1 following the municipal election at which councilmembers are elected. K. The city council, by a majority of the membership of the council, shall make all appointments to city commissions and committees except for those provided for by Sections A4-2(J) and A4-2(K). L. The city council shall adopt a policy resolution pertaining to the duties of the mayor and amend same from time to time as required. (Ord. 391 § 3, 2007; Ord. 365 § 3 (part), 2004)
A4-4. - Rules of order.¶
Unless otherwise modified by this code, all proceedings before the city council shall be conducted in accordance with and pursuant to the parliamentary rules of procedure as prescribed in Robert's Rules of Order, a copy of which is on file in the office of the city clerk. A4-5. - Voting—Abstention.¶
Abstentions shall be considered affirmative votes if there are not sufficient affirmative votes to carry the motion. For purposes of this section and Section A4-6 of this chapter, a disqualification because of conflict of interest reasons shall not be considered an abstention. (Ord. 167 § 2 (part), 1989)
A4-6. - Voting—Ties.¶
A. Tie votes with no abstentions by any member of the city council are considered defeated motions and shall be carried forward to the next regular or special meeting of the city council. B. A tie vote shall not be considered a necessity for requiring a conflict of interest disqualified councilperson to participate in the governmental decision under the provisions of Section 87101 of the Government Code.
