A5-13. - Planning agency duties.

A5-11. - Establishment.

There is established a city planning commission. The powers and duties of such commission shall be as provided by this code and the general laws of the state. (Prior code § A5-19)

A5-12. - Membership—Terms of office.

A. The planning commission shall consist of five members appointed by the city council. B. The term of office of members selected to serve on the planning commission shall be four years beginning on July 1st and ending June 30th or until they are reappointed or their successors are appointed. In the event of a vacancy on the planning commission, the person selected to fill the vacancy shall serve for the remainder of the unexpired term. If fewer than six months remain in the unexpired term, the city council has the option of appointing a person to serve the remainder

of the unexpired term or the unexpired term followed by a full term. Due to the change in the general municipal election of mayor and councilmembers to even years, the terms of all planning commissioners shall be lengthened by one year in 2018 to achieve odd year appointment of planning commissioners. C. All members shall be at least eighteen years of age and a resident of the city. D. Every commissioner shall file an original affidavit of residency, signed under penalty of perjury, with the city clerk at the time their application is filed with the city clerk. No commissioner shall be appointed nor may he or she serve on a commission if an affidavit of residency has not been filed. (Ord. 196 § 1, 1990: Ord. 195 § 1, 1990: prior code § A5-20) (Ord. A5-13. - Planning agency duties.

The planning commission shall be the planning agency under Chapter 3 of Title 7 of the Government Code for the following functions: A. To develop such specific plans as may be necessary or desirable. It may or, if so directed by the city council, prepare specific plans based on the general plan and drafts of such regulations, programs and legislation as may in its judgment be required for the systematic execution of the general plan. It may recommend such plans and measures to the city council for adoption; B. To investigate and make recommendations to the city council upon reasonable and practical means for putting into effect the general plan or part thereof, in order that it will service as a pattern and guide for the orderly physical growth and development of the city and as a basis for the efficient expenditure of its funds relating to the subjects of the general plan; the measures recommended may include plans, regulations, financial reports and capital budgets; C. To endeavor to promote public interest in and understanding of the general plan and regulations relating to it; D. To consult and advise with public officials and agencies, public utility companies, civic, educational, professional and other organizations and citizens generally with relation to carrying out the general plan.
