B4-2. - Applicability of state law.¶
B4-1. - Restrictions.¶
A. No person shall possess or ignite in any manner, any firecracker or fireworks, including any article for the making of a pyrotechnic display. Nothing contained in this section, however, shall prohibit any discharge or display of fireworks defined and classified as "safe and sane fireworks" in Section 12529 of the California Health and Safety Code at any public gathering or patriotic celebration provided a permit for such discharge or display has been obtained from the director. B. Violations of this section shall be punishable under the provisions of Sections 12671—12689 of the Health and Safety code and shall be punishable as either a misdemeanor or a felony, as provided in Health and Safety Code Sections 12671—12689. Section B4-1 of this chapter does not forbid or control acts or matters expressly allowed, permitted or licensed pursuant to Sections 12506 and 12508 of the Health and Safety Code; nor does it allow acts or matters more strictly forbidden or controlled by state law or by local fire regulations.
