B1-121. - Intent and purpose.¶
The city regulates special event activities to ensure that the best interests of the public and residents of the city are upheld at all times. A special event permit assures certain levels of public safety, proper use of facilities, and minimum disturbance of residential areas. (Ord. 231 § 3 (part), 1992)
B1-122. - Permit required.¶
A. Requirement. A special event permit is required whenever: 1. The proposed event deviates from the approved use under the zoning ordinance or if the event may impact normal use of a public or private facility; or 2. The event is likely to have an impact on the public right-of-way or involves the use of public property.
Every person shall apply for and secure from the city a special event permit before promoting, conducting or engaging in a special event regulated by this chapter. Examples of the types of activities which require a special event permit and are regulated by this chapter include: parades, processions, carnivals, fairs, agricultural sales, animal shows, festivals, arts and crafts shows, bicycle races, Christmas tree sales, circuses, civic and community events, commercial filming, live entertainment events, outdoor exhibits, recreational events, religious assembly, outdoor retail sales, foot races/walks, street fairs, swap meets and trade fairs.
B. Exemptions. The following activities are exempt and do not require a special event permit: uses permitted under the zoning ordinance; funeral processions; and activities self-contained within the confines of private property which will not adversely affect the public right-of-way. Use of the community center or senior center and library buildings is governed by separate reservation procedures. (Ord. 231 § 3 (part), 1992)
B1-123. - Permit application.¶
A person seeking a special event permit shall submit to the city's parks and community services department an application on a form provided by that department. The application shall include: A. The name of the applicant; B. The person in charge of the activity; C. Details of the event including location, date(s), time, type of event, estimated number of participants, plans for set up and cleanup, use of outside vendors, use of amplification system; D. Site diagram, including location of first aid, restrooms, information, administration, emergency exits, route (for road or trail use), nearest cross streets; E. Certificate of insurance naming the city as an additional insured. Certificates of insurance shall be provided by a company licensed to do business in the state. The insurance terms and limits are established based upon the type of event, and must be acceptable to the city; F. Crowd control plan, parking plan, cleanup plan, security plan; G. Other information which the department reasonably may require. (Ord. 231 § 3 (part), 1992)

B1-124. - Application procedure.¶
A. General. Once the permit application is complete, the community services manager or designee shall assist the applicant in obtaining the necessary approvals from each affected city department and from the San Ramon Valley Fire Protection District or Dougherty Regional Fire Authority. A department may note special conditions on the application. The city manager or his or her designee is authorized to issue the permit, consistent with the city's special event procedures and policies. Because of the demand on city services, the city may elect not to approve more than two special event permits per month. B. Public Assemblies and Demonstrations. If an application is for a public assembly or demonstration at which people propose to demonstrate their support for a particular viewpoint or belief, the city shall grant the permit within twenty-one days or less, subject to reasonable restrictions on the time, place and manner of conducting the demonstration. The restrictions may be designed to maintain public safety and to prevent the activity from unreasonably interfering with nearby activities, but may not restrict the content of the ideas. B1-125. - Fees.¶
The fee for a special event permit is the amount established by resolution of the city council. The fee includes the cost of processing and evaluating the permit, and the cost of police and public services units and other city personnel, depending on the nature and requirements of the event. Depending upon the type of activity, the applicant may also be required to obtain a business license or an encroachment permit, or both. (Ord. 231 § 3 (part), 1992)
B1-126. - Permit limitation—Revocation.¶
A permit applies only to the person or organization in whose name it is issued, and to the date, location, public street or public place specified in the permit. A permit may not be transferred or assigned. The city manager may revoke a permit for good cause. (Ord. 231 § 3 (part), 1992)
