A1-11. - Content.

The San Ramon Municipal Code consists of all ordinances adopted by the city council which are of a general and permanent nature. An ordinance relating to the following subject matter is not considered an ordinance of general and permanent nature and need not be included in this code:

A. The naming of a street, road or highway; B. The granting, altering or withdrawing of a franchise; C. The calling of an election; D. The adopting of interim zoning regulations; E. The zoning or rezoning of a particular parcel of property; and F. Such other ordinances of a special or particular subject matter which the city council considers is not appropriate to be in a general compilation of laws of a general and permanent nature. A1-12. - Organization and classification.

The ordinances of the city which are of general and permanent nature shall be organized and classified under the following titles and divisions: A. TITLE A, General and Administration; B. TITLE B, Regulations; C. TITLE C, Construction, Development and Land Use; D. TITLE D, Zoning (on file in the city clerk's office). (Prior code § A1-3)

A1-13. - Copies.

A. One copy of this code certified by the city clerk shall be kept on file in the office of the city clerk for use and examination by the public. As an amendment, addition or other change to the code is made, it shall be noted by ordinance number on the appropriate pages of the code. The city clerk shall also keep a file of amendatory ordinances indexed for reference. B. This code may be reproduced in quantity and sold in such a manner as the city council directs. A1-14. - Citation.

This code may be cited as the "San Ramon Municipal Code." It may be so cited in any prosecution for violation of this code. (Prior code § A1-5)

A1-15. - Reference includes amendments.

Whenever reference is made to any portion of the code, the reference applies to all amendments and additions now or hereafter made. (Prior code § A1-6)

A1-16. - Effect of headings.

Title, division, chapter, article or section headings, when contained in this code, shall not be deemed to govern, limit, modify or in any manner affect the scope, meaning or intent of the provisions of any title, division, chapter, article or section. (Prior code § A1-9)

A1-17. - Jurisdiction.

This code refers only to the omission or commission of acts within the territorial limits of the city and to that territory outside of the city over which it has jurisdiction or control by the Constitution, law or ownership or control of property. (Prior code § A1-10)

A1-18. - Prohibited acts include causing, permitting.

Whenever in this code an act or omission is made unlawful, it includes causing, permitting, aiding, abetting, suffering or concealing the fact of the act or omission. (Prior code §§ A1-11, A1-20)

A1-19. - Delegation of powers and duties.

Whenever a power is granted to or a duty imposed upon a public officer, the power may be exercised or the duty may be performed by a deputy of such officer or by a person otherwise duly authorized pursuant to law, unless this code expressly provides otherwise. (Prior code § A1-12)

A1-20. - Effect on past actions and obligations.

No action or proceeding begun before this code takes effect, and no right accrued, is affected by its provisions. (Prior code § A1-21)

A1-21. - Construction of provisions.

Unless the provisions of the context of this code otherwise require, the general provisions, rules of construction and definitions set out in this chapter shall govern the construction of this code. (Prior code § A1-7)

A1-22. - Interpretation of grammar and language.

A. As used in this code, the masculine gender includes the feminine, and the feminine includes the masculine. B. As used in this code, the singular number includes the plural, and the plural includes the singular. C. The use of the title of any officer, employee, office, commission, department or board means that officer, employee, office, commission, department or board of the city of San Ramon. D. As used in this code, "shall" is mandatory and "may" is permissive. E. As used in this code, the present tense includes the past and future tenses, and the future includes the present. F. As used in this code, all references to "sheriff" and "sheriff's department" are deemed to refer to the "city of San Ramon police chief" and the "city of San Ramon police services department" respectively. A1-23. - Definitions.

In this code, unless the context otherwise requires: City is the city of San Ramon.

City council is the city council of this city. City manager is the appointed official of the city who occupies the position as chief administrative officer of the city. County is the county of Contra Costa. Oath includes affirmation. Officers and employees signifies all incumbents, officers and employees and their officers, assistants, deputies and employees. Operate includes to engage in, carry on, keep, conduct, maintain or cause to be carried on, kept, conducted or maintained. Owner, as applied to a building or land, includes a part owner, joint tenant, tenant, tenant in common, or joint tenant of the whole or a part. Person means a natural person, firm, association, organization, partnership, business trust, company, corporation, joint venture, club, or its manager, lessee, agent, servant, officer or employee and includes a county, public agency, public corporation, public district or political subdivision of the state. Sale includes any sale, exchange, barter or offer for sale. State is the state of California. Street includes a highway, avenue, lane, alley, court, place, square, curb, and other public ways in the city which are dedicated and open to public use. "Street" also includes such other public property designated as such by law. Tenant or occupant, applied to a building or land, includes a person who occupies the whole or part of the building or land, whether alone or with others. Year means the fiscal, unless the calendar year is specifically designated. (Prior code § A1-14)

A1-24. - Computation of time.

The time in which action provided by this code is to be done is computed by excluding the first day and including the last, unless the day is a holiday, and then it is also excluded. (Prior code § A1-64)

A1-25. - Constitutionality.

If any section, subsection, sentence, clause or phrase of this code is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this code. The city council declares it would have passed this code, and each section, subsection, sentence, clause and phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases may be held invalid.
