B1-41. - Permit—Issuance.

A valid cardroom employee work permit may be issued either by the chief of police of the city or the county sheriff. (Prior code § B1-27)

B1-42. - Permit—Application.

A. Applications to the sheriff of Contra Costa County will be governed by the provisions of Article 52-3.7 of the Contra Costa County Code except that the fee referred to in Section 52.3.707 (c) of said code shall be paid to the city clerk. B. Application for a cardroom work permit to the chief of police will be made by the employee presenting himself or herself to the chief of police's office during normal business hours, and prior to the beginning or commencement of any such employment and be registered. C. Each employee applying for a cardroom work permit from the chief of police shall: 1. Complete a brief application; 2. Be fingerprinted;

  1. Be photographed; 4. Provide any other information that the chief of police may require; 5. Certify under penalty of perjury that the contents of the application are true to his or her own knowledge; and 6. Pay a nonrefundable fifty-dollar fee to the chief of police for processing the application.

D. Upon approval of the chief of police of a cardroom work permit, the applicant will pay the city clerk a nonrefundable nonproratable permit fee of fifty dollars. (Prior code § B1-28)

B1-42. - Permit—Renewal.

A. Before the end of the eleventh month of the permit's life, the permittee may apply to the issuer of the permit to renew it. B. The procedure for applying for a renewal from the chief of police shall approximate that set forth in Section B1-42 of this chapter and in Sections 52-3.32(c), 52-3.703 and 52-3.707 of the Contra Costa County Code for applications to the county sheriff, except that: 1. The application fee is twenty-five dollars; 2. No fee is due for issuing the permit. (Prior code § B1-30)

B1-44. - Registration—Denial—Suspension or revocation.

A. If it appears at any time that good cause may exist for the chief of police to refuse to register an employee, or to suspend or revoke a previous registration, whether issued by the chief of police or the county sheriff, he shall give such employee, and the licensee, reasonable opportunity to show cause why he should not refuse to register such employee, or why he should not suspend or revoke the registration of such employee, and thereafter, if he finds good cause therefor, he may refuse to register such agent or employee, or suspend or revoke the registration of such agent or employee. B. The chief of police may refuse to register an employee if substantial evidence available to him causes him to conclude that the employee does not possess good moral character. In making such determination, the chief of police shall consider: 1. All criminal convictions of such employee, the reasons therefor, and the actions of such employee subsequent thereto; 2. That the employee has intemperate habits, or a bad reputation for truth, honesty and integrity; 3. That the employee has been refused, or has had revoked, any license or permit by an agency of government for lack of good moral character; 4. That the employee has violated any provisions of this chapter; 5. That the employee has knowingly made a false statement in his application. (Prior code § B1-31)

B1-45. - Appeals.

The decision of the chief of police refusing to register, or suspending or revoking a previous registration of a cardroom employee may be appealed to the city council in the manner set forth in Section A1-51 of this code. (Prior code § B1-36)

B1-46. - Permits subject to review by state.

All applications for work permits shall be forwarded for review by the State Division of Gambling Control. The Division of Gambling Control, upon review, may object to the grant of a work permit. If an objection is received from the Division of Gambling Control, the work permit may not be issued. Moreover, in addition to any other restrictions provided by law, no work permit shall be issued to anyone who is disqualified from holding a state gambling license for any of the reasons specified in Business and Professions Code Section 19850.
