2.60.010 - Section 31681.5 of state code to apply.

The provisions of Section 31681.5 of the Government Code of California relating to increases in specified retirement allowances are made applicable in Marin County.

2.60.020 - Section 31676.95 of state code to apply.

The board of supervisors of the county of Marin, state of California, as the government board of the county, hereby elect that the Marin County retirement system, the members, and retired members thereof, shall be subject to the provisions of Section 31676.95 of the Government Code of California, effective July 1, 1964.

2.60.030 - Applicability of Article 16.5 of California Code.

The provisions of Article 16.5 of Chapter 3, Part 3, Division 4, Title 3 (Sections 31870, et seq.) of the California Government Code relating to cost of living adjustments are made applicable in Marin County as of April 1, 1970.

2.60.040 - Section 31725.5 of state code to apply.

The provisions of Section 31725.5 of the Government Code of California relating to the remedy of incapacity by change of position; payments in lieu of disability retirement allowances are hereby made applicable in Marin County.

2.60.045 - Applicability of Section 2.60.040.

Pursuant to Section 31725.5, the provisions of the Section 2.60.040 shall be applicable to persons retired for disability before the effective date of the ordinance codified in Section 2.60.040 and this section and to those retired for disability subsequent to such effective date.

2.60.050 - Section 31641.03 to apply.

A. Pursuant to the provisions of Government Code Section 31641.03, the members of the Marin County retirement system designated below shall be credited, as time served for retirement purposes, with one hundred percent of their accumulated sick leave (credit shall be based on the normal number of duty hours per year of the member's class as of the date of their retirement) but such credit shall not exceed two years. This credit shall be in addition to all other service credit.

B. The provisions of this section shall apply only to members who:

  1. Have accumulated at least six months of sick leave as of the date of their retirement; and

  2. Have qualified for and received additional service credit in accordance with the provisions of Government Code Section 31641.03 and the resolutions of the board of supervisors implementing said section.

2.60.055 - Credit for accumulated sick leave for retirement pay.

Pursuant to Section 31641.03 of the Government Code, those members of the Marin County employees retirement association who are employed by the county of Marin in unrepresented units, or bargaining units subject to an executed memorandum of understanding (M.O.U.) granting them benefits allowed by Section 31641.03 of the Government Code and this section, shall receive credit for such percentage of sick leave accumulated as of the date of their retirement, as has been agreed upon in the respective M.O.U.s for represented employees, or specified in Administrative Regulation No. 3 for unrepresented employees, and such sick leave credit shall be in addition to service credit. The cost to the retirement system shall be borne by the county of Marin.
