2.18.010 - Findings and purpose.

It is the intent of the board of supervisors that this chapter shall govern the selection of contractors by the county through the bidding procedures specified in Article 3, Chapter 2, Part 3, Division 2 of the Public Contract Code section 22000 et seq. or its statutory successor. This county has elected to become subject to the Uniform Public Construction Cost Accounting Procedures pursuant to the Public Contract Code.

2.18.020 - Definitions and exclusions.

The definitions employed in Article 3 of Chapter 2, Part 3, Division 2 of the Public Contract Code section 22000 et seq. and its statutory successor shall govern the construction of this chapter. Except as otherwise provided herein, the provisions of Article 3, Chapter 2, Part 3, Division 2 of the Public Contract Code shall be controlling.

2.18.030 - Public Contracts Code Article 3 adopted—Contract letting procedures.

Pursuant to Public Contract Code sections 22032 et seq., contracts for public projects up to the maximum dollar amounts set forth in Public Contract Code section 22032(b), as may be amended from time to time, may be awarded by informal procedures as forth herein:

(a) A list of qualified contractors shall be developed and maintained in accordance with the provisions of Section 22034 of the Public Contract Code and criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission.

(b) All contractors on the list for the category of work being bid and all construction trade journals specified in Section 22036 of the Public Contract Code shall be mailed a notice inviting informal bids, except with respect to proprietary services or products. The mailing of notices to contractors and construction trade journals shall be completed not less than ten calendar days before bids are due. The notice inviting informal bids shall describe the project in general terms, how to obtain more detailed information about the project, and state the time and place for the submission of bids.

(c) Authority to award informal contracts is hereby delegated to the department head responsible for the public project, including but not limited to the director of public works, the purchasing agent or county administrator.

(d) If all bids received are in excess of the amount specified in Public Contract Code section 22032(b), your board may, by passage of a resolution by a four-fifths vote, award the contract at the amount set forth in Section 22034(d) of the Public Contract Code or less to the lowest responsible bidder, if it determines the cost estimate of the responsible department head was reasonable.

(e) If the project cost is the same or less than the amount specified in Public Contract Code section 22032(a), as may be amended from time to time, the work may be performed by county employees by force account, by negotiated contract or by purchase order.
