Article 1 — Arrest Powers

Sec. 3-14.1.01. - Authority.

Penal Code Section 836.5 provides that a public officer or employee, when authorized by ordinance, may arrest a person without a warrant under certain specified circumstances. Custodial officers are public officers pursuant to Penal Code Section 831.

Sec. 3-14.1.02. - Conditions.

A custodial officer may:

(a)

Make arrests for misdemeanors and felonies within the local detention facility pursuant to a duly issued warrant;

(b)

Make warrantless arrests, pursuant to Penal Code Section 836.5, under the following circumstances:

(1)

When assigned as bailiff pursuant to Penal Code Section 831.5,

(2)

When assigned limited law enforcement responsibilities under the supervision of a peace officer during a state of emergency as defined in Government Code Section 8858;

(c)

This Article shall remain in effect until January 1, 2003, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2003, extends the authority of custodial officers.
