Chapter 12 — AIR TOXIC "HOT SPOT" FEES

Sec. 3-12.01. - Purpose.¶
In 1987 the Legislature enacted the Air Toxics "Hot Spots" Information and Assessment Act of 1987 for the purpose of collecting and evaluating information concerning the amounts, exposures and short and long term health effects of hazardous substances regularly released to the surrounding atmosphere form specific sources of hazardous releases. The legislation is found in Health and Safety Code Section 44300 et seq.

Sec. 3-12.02. - Authority for fees.¶
The Act further provides that each air pollution control district must adopt a fee schedule to recover the costs associated with implementing and administering the Act.

Sec. 3-12.03. - Application.¶
This Chapter shall apply to all facilities as defined in Section 44320 and following of the Health and Safety Code.

Sec. 3-12.04. - Notification; Failure to pay; Revocation of permit.¶
The Siskiyou County Air Pollution Control District shall notify each person who is subject to the fee of the obligation to pay the fee. If the person fails to pay the fee within sixty (60) days after receipt of the notice, the fee shall be increased by fifty (50) percent of the assessed fee and the person shall be notified by mail of the increased fee. The increased fee shall be paid within one hundred and twenty (120) days following receipt of the second notice. Failure to pay fees within 120 days from the second notice may result in permit revocation.
If any permit is revoked, it shall be reinstated only upon full payment of the overdue fee plus any late penalty, and a reinstatement fee to cover administrative costs of reinstating the permit.

Sec. 3-12.05 - Fee schedule.¶
For sources that emit less than ten (10) tons/year of $50.00 total organic gases, particulates, oxides of nitrogen or sulfur
For sources which emit more than ten (10) $50.00 plus $12.50 per ton tons/year of total organic gases, particulates, oxides of nitrogen or sulfur
